Aus der Menschenwürdegarantie in Verbindung mit dem Sozialstaatsprinzip des Grundgesetzes ergibt sich ein Regelungs- und Gestaltungsauftrag für die Politik. So ist zwingend geboten, dass der Staat die Grundvoraussetzungen für ein menschenwürdiges Dasein sichert. Das zu garantierende 'Existenzminimum' umfasst auch das Wohnen. Zu erwähnen ist außerdem, wie in der Statistik zu erkennen ist, dass das Verhältnis von Personen, die in Deutschland zur Miete leben, im Vergleich, zu denen die in Eigentum leben, überwiegt.
