The authors show that applying the… Cheapest Cost Avoider Principle (CCAP) instead of the Polluter Pays Principle (PPP) can lead to substantial welfare improvements.This book develops the foundations for the CCAP, which is shown to be superior to the PPP, both methodologically and practically, in identifying the most appropriate policy for dealing with external effects in transport. The PPP neglects the fact that external costs are jointly caused by all involved parties and that the externality problem is of a reciprocal nature: to avoid harm to a pollutee necessarily inflicts harm on the polluter. The real problem for welfare maximization - addressed by the CCAP - is to avoid the most serious harm. The CCAP guarantees efficiency, fair competition and equity. Its use of some form of cost-benefit analysis also helps to avoid regulatory failure. The CCAP incorporates 'polluter pays' as one possible outcome; however, this is not a foregone conclusion. Two case studies - showing that the methodology of the CCAP can be applied in practice - and a critical assessment of the European greening transport policy complete this volume.Discussing the relevance of the economic analysis of law for transport policy, this book will appeal to academics in the fields of law and economics, environmental policy and regulatory impact assessment, and European transport policy. Policymakers and civil servants concerned with transport policy, environmental policy and regulatory impact assessment will also find this book valuable.

Interfunktionen, an art journal which published 12 issues between 1968 and 1975 in Cologne, was founded in 1968 as a form of protest by artists who had no affinity with the critical lines that were redrawn at Documenta that year. The review wa…s of considerable importance as a vehicle for propagating pro-European ideas and as a union between artists in Europe and the United States, irrespective of the predominating movements of the time. It contained both theoretical and practical contributions, with the intervention of creators who defined and illustrated their artistic strategies. Directly linked to the most prominent figures in the Düsseldorf Kunstacademie, such as Joseph Beuys, Jorg Immendorf and Sigmar Polke, it also boasted the involvement of the most spirited and reflexive artists of the times, from Vito Acconci and Marcel Broodthaers to Bruce Nauman and Dieter Roth. Interfunktionen, as its name indicates, was an inter-disciplinary publication, open to all artistic genres and with no restrictions as to media. This book is produced in collaboration with Fritz Heubach, the review's first editor, and depicts the experience of those years by means of original documents--some of them hitherto unpublished--artworks, and artists' writings.

Kernpunkt der in Deutschland in Wirtschafts- und Akademikerkreisen geführten Corporate Governance Debatte ist die Frage, wie sichergestellt werden kann, daß das Management einer Unternehmung den Firmenwert nachhaltig im Interesse der Anteilseigner und anderer Stake-holder mehrt. Auch die oftmals beklagte mangelnden Kontrolle durch den Aufsichtsrat spielt hier eine tragende Rolle.Ein Teilaspekt dieser Diskussion beschäftigt sich mit der persönlichen Haftung von Managern und Aufsichtsräten. Das Haftungsrisiko der Unternehmensleiter wird als probates Mittel eingeschätzt, Mißmanagement, mangelnde Ausübung von Überwachungsaufgaben und Fahrlässigkeit bei der Unternehmensführung zu vermeiden. Dennoch ist die Bewertung der tatsächlichen Haftungsrisiken in Praxis und Literatur nicht einheitlich. Werden sie einerseits als noch nicht ausreichend angesehen, um eine verhaltenssteuernde Wirkung zu erzielen, sprechen andere von der Untragbarkeit der Risiken, denen Unternehmensleiter heutzutage ausgesetzt sind. Von dieser Seite wird denn auch das in Deutschland relativ neue Deckungskonzept der Directors and Officers Liability Insurance begrüßt. Die D&O-Vericherung, wie sie abgekürzt wird, ist die einzige Versicherung, die Unternehmensleiter davor schützt, Schadenersatzforderungen, die aufgrund ihrer Tätigkeit im Unternehmen gegen sie erhoben werden, aus dem persönlichen Vermögen begleichen zu müssen.Vor dem Hintergrund der aktuellen Corporate Governance Debatte in Deutschland stellt sich die Frage, ob mit dieser faktischen Neutralisierung der Haftung falsche Anreize für Manager gesetzt werden. Schließlich wird ein Analyserahmen zur ökonomischen Untersuchung von Corporate Governance Problemen definiert und dazu benutzt, die verschiedenen Effekte der D&O-Versicherung theore-tisch zu untersuchen und anhand von empirischen Daten zu belegen.Als Ergebnis läßt sich festhalten, daß Schadenersatzversicherungen für Manager und Aufsichtsräte durchaus eine wichtige Rolle innerhalb der Corporate Governance spielen. Die anreizverzerrende und damit aktionärsschädigende Wirkung von D&O-Versicherungen kann theoretisch begründet werden. Es ist aber festzustellen, daß eine Reihe von Marktmechanismen und gesetzlichen Regelungen diesen Effekten entgegenwirkt, so daß eine unternehmenswertmindernde Wirkung bisher empirisch nicht nach-gewiesen werden kann. Zudem kann dargestellt werden, daß D&O-Versicherungen durchaus auch disziplinierend auf das Verhalten von Unternehmensleitern einwirken können und mitunter sogar ext. 100 pp. Deutsch.
