Die Tätigkeit der mit der Aufarbeitung von Massengewalt beauftragten Institutionen, z.B. des Internationalen Strafgerichtshofs, der nationalen Jurisdiktionen, der modifizierten traditionellen Gerichtsbarkeiten und der Wahrheitskommissionen, sind Gegenstand zahlreicher Untersuchungen und Berichte. Die Möglichkeit einer Kombination der einzelnen Mechanismen und Systeme zur effizienten und umfassenden Aufarbeitung von Massengewalt blieb jedoch bislang weitgehend unberücksichtigt.Die vorliegende Arbeit befasst sich daher mit der parallelen Nutzung internationaler, nationaler und (neo-)traditioneller Sanktionssysteme im Umgang mit Massengewalt. Sie untersucht diese Sanktionssysteme strafrechtsvergleichend und gibt Aufschluss darüber, ob und wie ein pluralistischer Ansatz sinnvoll sein kann. Am Beispiel der sanktionsrechtlichen Reaktionen auf den ruandischen Völkermord von 1994 wird die Bewältigung von Massengewalt durch das Strafrecht und andere rechtsförmige Sanktionsverfahren analysiert, wobei vornehmlich drei Gerichtsbarkeiten berücksichtigt werden: das International Criminal Tribunal for Rwanda, die modernen ruandischen Strafgerichte und die neotraditionellen Gacaca.Der Autor legt dar, dass alle drei Rechtssysteme zwar die gleichen Ziele verfolgen, ihre Ansätze und Wirkungsweisen jedoch gänzlich verschieden sind. Erst ihre Kombination ermöglicht daher eine umfassende Aufarbeitung des geschehenen Unrechts. Ferner extrahiert die Arbeit strukturelle Rechtskomponenten und entwickelt ein pluralistisches Modell der Transitional Justice, das in zukünftigen Fällen eine effektivere juristische Aufarbeitung der vorangegangen Verbrechen ermöglichen soll.; Dissertationsschrift.
