Sie erleichtert multinationalen Unternehmen ihre Geschäfte, auch außerhalb ihres Heimatlandes, nach ihren Vorstellungen zu gestalten. Dazu gehört auch, dass Staaten eben diesen multinationalen Unternehmen einen Anreiz bieten möchten, Investitionen in diesem Staat zu tätigen, zum Beispiel indem man bestimmten Personengruppen oder Geschäftszweigen eine bevorzugte oder niedrigere Besteuerung anbietet (sog. Eine Maßnahme dabei ist die Einführung von Controlled Foreign Company-Regelungen. Als "Controlled Foreign Companies" werden überwiegend Gesellschaften ("companies") bezeichnet, die ihren Sitz im Ausland ("foreign") haben und die von ihren im Inland ansässigen Gesellschaftern beherrscht ("controlled") werden. Das Problem der Gewinnverlagerung vom Inland in ein Niedrigsteuerland wird oft als Steuerflucht bezeichnet und wird von den meisten Staaten als ungerechtfertigte oder missbräuchliche Steuerreduzierung durch Ausnutzung internationaler Steuergefälle angesehen. Da die Verlagerung der Gewinne vom Inland ins minder besteuerte Ausland meist durch die Errichtung von Controlled Foreign Companies erfolgt, versuchen die Staaten mittels der Einführung von CFC-Gesetzgebungen, die Einkünfte dieser ausländischen Gesellschaften unter bestimmten Voraussetzungen auch der heimischen Steuer zu unterwerfen. Die CFC-Legislation stellt demnach einen Sammelbegriff der steuerlichen Normen dar, die unter bestimmten Voraussetzungen die juristische Selbständigkeit der Unternehmen negiert und einen Zugriff des Sitzstaates des Anteilseigners auf die Gewinne der Gesellschaft ermöglicht.
