Sodann wird eine Abgrenzung zur Doctrine of Consideration vorgenommen, um die Eigenständigkeit der Privity of Contract zu belegen. Der anschließende Teil der Arbeit befasst sich mit der detaillierten Betrachtung und Analyse der Ausnahmen und Umgehungsmöglichkeiten zur Privity of Contract, welche vornehmlich von der Rechtsprechung aber auch der Legislativen entwickelt wurden, und ihrer Auswirkungen auf die Gesamtrechtslage. Ferner folgt eine umfassende Betrachtung verschiedener Reformbestrebungen und deren Wirkung auf die Rechtsprechung. Schließlich erfolgt eine Auseinandersetzung mit dem Reformgesetz und dessen Auswirkung auf die bestehende Rechtslage.; Dissertationsschrift.
