Zur Kostendämpfung wurden Eingriffe in die Grundrechte von Versicherten und Leistungserbringern vorgenommen. Obwohl keines der Gesetze dauerhaft gewirkt hat, wurde die Politik der Kostendämpfung fortgesetzt. Das Bundesverfassungsgericht (BVerfG) entwickelte zur verfassungsrechtlichen Rechtfertigung der Eingriffe den Grundsatz der finanziellen Stabilität der gesetzlichen Krankenversicherung. Bei diesem Grundsatz handele es sich um einen überragend wichtigen Gemeinwohlbelang, der auch objektive Berufswahlregelungen rechtfertigen könne. Darüber hinaus habe der Gesetzgeber bei der Ausgestaltung der GKV einen weiten Spielraum.Nils Schaks untersucht diese Rechtsprechungslinie des BVerfG, wobei er zunächst den Inhalt des Grundsatzes analysiert. Dieser ist kein gesundheitsschützender, sondern ein rein finanzieller Belang. Anschließend setzt er sich mit den beiden zentralen Thesen des BVerfG auseinander. Der Autor kommt zu dem Ergebnis, dass der Grundsatz der finanziellen Stabilität der GKV nicht überragend wichtig ist. Der Grundsatz hat nicht die rechtfertigende Kraft, die das BVerfG ihm beimisst, es handelt sich um einen bloßen finanziellen/fiskalischen Belang, der keinen Verfassungsrang genießt. Schließlich ist der Spielraum des Gesetzgebers geringer als vom BVerfG angenommen. Entscheidend für die gerichtliche Kontrolldichte ist die Intensität des Eingriffs. Würde das BVerfG dieselben Maßstäbe, die es in seiner sonstigen Rechtsprechung anwendet, auf die Entscheidungen zum Grundsatz der finanziellen Stabilität der gesetzlichen Krankenversicherung übertragen, so hätten diese Entscheidungen anders ausfallen müssen. Im Ergebnis ist der im Schrifttum erhobene Vorwurf des Sonderrechts deshalb berechtigt.; Dissertationsschrift.
