Cum ex-Geschäften - zum Teil mehrere Steuerbescheinigungen ausgestellt, obwohl die bescheinigte Kapitalertragsteuer nur einmal erhoben wurde. Mit Einreichen der Steuerbescheinigungen wurde der einmal erhobene Steuerbetrag sodann mehrfach angerechnet oder erstattet. Dem Fiskus ist dadurch ein Steueraufkommen in Milliardenhöhe entgangen.Zu den Mehrfachbescheinigungen konnte es kommen, da der Erhebungs- und der Bescheinigungsvorgang der Kapitalertragsteuer bis 2012 auseinander fielen: Die Kapitalertragsteuer war von der emittierenden Aktiengesellschaft abzuführen, die Bescheinigung über die Steuererhebung wurde hingegen erst durch die Depotbank ausgestellt. Die Depotbanken konnten bei girosammelverwahrten Aktien nicht erkennen, ob zuvor ein Leerverkauf stattgefunden hatte und bereits Steuerbescheinigungen ausgestellt wurden. Sie stellten daher Steuerbescheinigungen zu viel aus. Aber auch bei Wertpapierleihen über den Dividendenstichtag wurden mehrfach ausgestellte Steuerbescheinigungen zur Anrechnung genutzt. Der BFH entschied in seinem Urteil vom 16.04.2014, dass auch hier unzulässig angerechnet wurde.Mit dem Jahressteuergesetz (JStG) zu 2007 löste der Gesetzesgeber das Problem der Mehrfachanrechnungen zumindest teilweise, indem er die Dividendenkompensation der Kapitalertragsteuer unterwarf und inländische Depotbanken zur erneuten Steuerabfuhr verpflichtete. Unter Beteiligung eines ausländischen Kreditinstituts auf Leerverkäuferseite wurden jedoch auch noch nach der Gesetzesänderung ohne erneute Steuererhebung mehrere Steuerbescheinigungen ausgestellt.Erst mit der Änderung des Erhebungssystems durch das OGAW-IV-Umsetzungsgesetz zu 2012 ist die mehrfache Bescheinigung nicht mehr zu befürchten. Sowohl die Abführung, als auch die Bescheinigung erfolgen nunmehr durch die Depotbanken des Kapitalertragsgläubigers. Für die Fälle vor 2012 sind jedoch entscheidende Rechtsfragen bis heute ungeklärt.
