Die Arbeit untersucht zunächst das tatsächliche Entscheidungsverhalten und vergleicht dabei Trennungsentscheidungen mit Entscheidungen zum Umgangsrecht, zur Alleinsorge und zur Vormundschaft. Das Gericht prüft die fachgerichtlichen Entscheidungen bei hoher Eingriffsintensität, d. h. in Trennungsfällen, besonders eingehend. Die Kontrolle erstreckt sich insbesondere auf die fachgerichtliche Tatsachenarbeit, das Gericht betätigt sich als Superberufungsinstanz. Anschließend widmet sich die Arbeit dem normativen Problem der Bestimmung der Kontrollgrenzen des Bundesverfassungsgerichts und greift dafür auf funktionell-rechtliche Argumente zurück.
