Vor dem Hintergrund der Urteile die zur Anerkennung der Rechtsfähigkeit von (AuÃen-) GbR und WEG führten, fragt es sich, ob Gleiches nicht auch für die Erbengemeinschaft als dritte der BGB-Gesamthandsgemeinschaften gelten muss. In diesem Band wird ein Ausschnitt dieser Problematik behandelt. Dargestellt werden die prozessrechtlichen Konsequenzen einer etwaigen Rechtsträgerschaft der Erbengemeinschaft. Auf der Basis geltenden Rechts werden Mà glichkeiten und Grenzen rationeller Erledigung von Streitigkeiten unter Beteiligung der Erbengemeinschaft im zivilprozessualen Verfahren aufgezeigt. Die Rechtsstellung der Erbengemeinschaft wird zunächst im vorprozessualen Bereich und sodann im Erkenntnis- und Vollstreckungsverfahren untersucht.
