The lethal nature acquired by terrorism has left no one unaffected. Innocent peoples are killed and injured in terrorist attacks, and their rights are violated. India is one of the countries of the world which is worst affected because of terrorism. The countries are enacting the laws to counter-terrorism. At the international level also efforts are made to tackle the menace of terrorism. India from time to time enacted the laws to counter-terrorism. However, the menace of terrorism is still plundering the civilised society. This book discusses that the countermeasures adopted at national (especially India) as well as national levels fall short of achieving their objectives. As the laws enacted to tackle terrorism are not in conformity with the principles of human rights, and the situation at the international level also is not comprehensively positive. War against terror cannot be won over by undermining the fundamental human rights. This book deals with different aspects of terrorism, anti-terror laws and human rights. This book will serve as a useful resource for students, research scholars, academicians and even to general readers. Issued without a dust jacket. -- A legal and political analysis of how the UN's two main bodies - the General Assembly and the Security Council - have addressed terrorism over six decades. It evaluates more than 130 resolutions to determine if these measures are both legal under international law and perceived as legitimate by member states. Core Themes and Framework: - Legality vs. Legitimacy [the book distinguishes between legality (whether a measure falls within the legal powers of the UN organ) and legitimacy (the "quality" of a measure that encourages member states to comply)]; - Thomas Franck's Theory [van Ginkel applies legal scholar Thomas Franck's four indicators of legitimacy - determinacy, pedigree, coherence, and adherence - to assess why some UN counter-terrorism policies are more effective than others]; - The Security Council's Evolution [the study examines the shift in the Security Council's role from a reactive body to one that adopts "legislative" and "adjudicative" functions, particularly after 9/11, and the resulting concerns about it overstepping its constitutional powers]; - General Assembly Focus [it analyzes the General Assembly's efforts to address the "root causes" of terrorism (such as misery and grievance) and its struggle to establish a universal definition of terrorism]. The author argues that the effectiveness of the UN's counter-terrorism policy is directly tied to its legitimacy. Member states are significantly more likely to implement and adhere to measures they perceive as legitimate, suggesting that strengthening these qualities is essential for a successful global policy.
