The author begins by examining the English common law system, which initially subjected the press to strict censorship and harsh punishments for violations. However, in 1792, the Fox Libel Act establi…shed the right of juries to determine both the fact and intent of libelous publications. This landmark legislation laid the foundation for the modern understanding of press freedom in England and its colonies, including the United States. The author then turns to France, where the press was also subject to government control. After the French Revolution, the Constituent Assembly introduced jury trials for press offenses, but these were later abolished during the Reign of Terror. Under Napoleon, the press was again censored, but the Bourbon Restoration brought a brief period of liberalization. However, it was not until the passage of the laws of 1819 that the jury trial for press offenses was definitively established in France. The author concludes by arguing that the jury trial has played a crucial role in protecting press freedom in both England and France. By giving juries the power to determine the guilt or innocence of those accused of press offenses, the jury system has ensured that the press can operate without fear of government reprisal. This has been essential for the development of a free and democratic society in both countries.
