Martina Eckardt überprüft die ökonomischen A…nreizmechanismen anhand der Entwicklung des deutschen Haftpflicht- und Unfallversicherungsrechts im 19. Jahrhundert theoretisch und empirisch. - Technische Innovationen bergen und erzeugen stets nicht vorhersehbare Risiken und Schäden. Da sich das Recht immer nur auf bereits bekannte Probleme bezieht, sind zur Regulierung solch neuartiger Schäden Rechtsinnovationen notwendig. Rechtliche Neuerungen werden durch die Rechtsprechung und Gesetzgebung hervorgebracht. Sie lassen sich als kumulativer Variations-Selektionsprozeß darstellen. Dieser Prozeß wird durch negative Verteilungseffekte der mit technischen Innovationen verbundenen neuartigen Schädigungen vorangetrieben. Da das Schadensvolumen der neuen Technik systematisch über ihren Marktzyklus variiert, lassen sich Hypothesen über das Auftreten von Rechtsinnovationen in Abhängigkeit vom Marktzyklus formulieren. Allerdings sind wegen der Nicht-Vorhersagbarkeit des Inhaltes der Rechtsinnovationen nur Aussagen über ihre Bandbreite möglich. In diesem Zusammenhang analysiert Martina Eckardt die zentralen ökonomischen, rechtlichen und politischen Selektionsbedingungen. Die Fruchtbarkeit einer solchen Theorie der Rechtsentwicklung stellt sie am Beispiel der Entwicklung des deutschen Unfallschadensrechts dar, für das das Eisenbahnwesen eine wesentliche Rolle spielte. Im Mittelpunkt ihrer empirischen Analyse steht das moderne Haftpflichtrecht und die rechtliche Regelung von Arbeitsunfällen durch das Unfallversicherungsgesetz im 19. Jahrhundert.
