Paperback. Condición: New. The terrorist attacks of September 11, 2001, and the ensuing 'war on terror' have focused attention on issues that have previously lurked in a dark corner at the edge of the legal universe. This book presents a systematic and comprehensive attempt by legal scholars to conceptualize the theory of emergency powers, combining post-September 11 developments with more general theoretical, historical and comparative perspectives. The authors examine the interface between law and violent crises through history and across jurisdictions, bringing together insights gleaned from the Roman republic and Jewish law through to the initial responses to the July 2005 attacks in London. Three models of emergency powers are used to offer a conceptualization of emergency regimes, giving a coherent insight into law's interface with and regulation of crisis and a distinctive means to evaluate the legal options open to states for dealing with crises.…

Hardcover. Condición: Very Good. Estado de la sobrecubierta: Very Good. 2023 OUP hardcover edition. Unread copy in very good condition. From the dustjacket: Governments, international organizations, and international laws and courts increasingly pay attention to conflict-related sexual violence. The core of the UN Women Peace and Security Agenda is stopping conflict-related sexual violence against women. Yet, with over two decades of grappling with conflict-related sexual violence and its legacies, there is only passing mention of the potential and obvious outcomes of sexual violence: pregnancy, abortion, forced maternity. What do we know about children conceived through acts of sexual abuse? What are their life chances? How do they exist with their mothers and within their families? In this collection we hear from the leading researchers and practitioners from around the globe, each of whom has spent decades working with women who survived wartime rape and with their children who were the result of that violence. This ground-breaking collection explores the life cycles of children born of wartime rape across time and space. It shines light on why young people born of rape are or are not able rejoin their families and society in the post-conflict. It explores the different ways these children learn about their origins and how they, their families and societies react to that understanding. It reveals the local, national, and international actions of how children born of wartime rape and their families are positioned in society and how they strive to transcend this and position themselves as they move from abuse, marginalization and pain into belonging and justice. Contents: 1. Challenging Conceptions - Kimberly Theidon PART I LIFE CYCLES: CHILDREN BORN OF WARTIME RAPE ACROSS TIME AND SPACE 2. Paperback. Condición: New. Gender oppression has been a feature of war and conflict throughout human history, yet until fairly recently, little attention was devoted to addressing the consequences of violence and discrimination experienced by women in post-conflict states. Thankfully, that is changing. Today, in a variety of post-conflict settings--the former Yugoslavia, Afghanistan, Colombia, Northern Ireland --international advocates for women's rights have focused bringing issues of sexual violence, discrimination and exclusion into peace-making processes. In On the Frontlines, Fionnuala Ní Aoláin, Dina Francesca Haynes, and Naomi Cahn consider such policies in a range of cases and assess the extent to which they have had success in improving women's lives. They argue that there has been too little success, and that this is in part a product of a focus on schematic policies like straightforward political incorporation rather than a broader and deeper attempt to alter the cultures and societies that are at the root of much of the violence and exclusions experienced by women. They contend that this broader approach would not just benefit women, however. Gender mainstreaming and increased gender equality has a direct correlation with state stability and functions to preclude further conflict. If we are to have any success in stabilizing failing states, gender needs to move to fore of our efforts. With this in mind, they examine the efforts of transnational organizations, states and civil society in multiple jurisdictions to place gender at the forefront of all post-conflict processes. They offer concrete analysis and practical solutions to ensuring gender centrality in all aspects of peace making and peace enforcement.…
