Der Gerichtsbarkeit des Menschenrechtsgerichtshofs unterfallen ausschlieÃlich Staaten. Dies ist eine Ausprägung eines zentralen Grundsatzes im Và lkerrecht, nach dem Staaten die Hauptsubjekte im Và lkerrecht sind. Unter bestimmten Voraussetzungen kà nnen jedoch Handlungen von nichtstaatlichen Akteuren einem Staat zugerechnet und somit vom EGMR oder anderen internationalen Spruchkà rpern geahndet werden. Das Ziel dieser Studie ist, die Reichweite der staatlichen Verantwortung für Taten von Individuen im Và lkerrecht zu bestimmen. Dafür wird eine rechtsvergleichende Untersuchung der Spruchpraxis des EGMR und des UN-Antifolterkomitees zu Verstà Ãen gegen das Folterverbot durch Privatpersonen durchgeführt. Der Gerichtshof ist einer der ersten Institutionen gewesen, die das internationale Folterverbot rechtlich durchgesetzt haben. Das UN-Antifolterkomitee wurde eigens für die Bekämpfung von Folter eingerichtet. Der Untersuchungsgegenstand dieser Studie umfasst Fälle von Kindesmissbrauch, Gewalt in engen sozialen Beziehungen, weibliche Genitalverstümmelung und Ehrenmorde. Ein besonderer Schwerpunkt liegt auf Refoulement-Fällen, in denen die Missbrauchsgefahr im Zielstaat von Individuen wie zum Beispiel Clan-Mitgliedern oder terroristischen Vereinigungen ausgeht. Die Frage nach der Reichweite der Verantwortung eines Entsendestaates in derart gelagerten Fällen ist vor dem Hintergrund der "Migrationskrise" von 2015 und damit verbundenen Abschiebungen und Zurückweisungen umso bedeutender. Im Rahmen der Analyse werden auch die Konzepte der Schutzpflicht und der Sorgfaltspflicht untersucht.
