Restructuring procedures are playing a vital role in businesses' survival, and new out-of-law mechanisms such as moratorium agreements and private workouts have become essential to preserve businesses. It is clear that the role of the law has completely changed, and this book argues that constants outside of the law are new ways to promote an 'uncodified-codification' of the law. The case for uncodified uncertainty in the Covid-19 crisis is a primary example of how no codification process can ignore the importance of out-of-law instances in the act of making law. But this raises an important question: is further growth in advanced economi…es able to increase well-being once people's basic subsistence needs are met Some advanced market economies, e.g. the United States, have exhibited a decline in well-being, both subjectively and objectively measured, over several decades despite seeing economic growth during the same period. This book provides an original and comprehensive explanation: economic growth, as driven by market forces, induces people, through both the demand- and supply-side channels, to pursue command over more material resources, and this weakens the self-generation of capabilities, putting well-being at risk of deterioration. The book argues, with the support of a variety of evidence, that the challenge can be overcome if governments' policies and people's choices pursue, as their ultimate goal, 'fundamental human development' on an evolutionary basis: the development of the capability of a typical person to conceive and share with others new purposes, to pursue them individually or collectively, and thus to contribute to building human culture. If such human development is prioritised, it makes people satisfied with their lives and resistant to adverse shocks, and it can even shape the pattern of economic growth. By contrast, if economic growth is prioritised, it tends to weaken and impoverish fundamental human development, and consequently people's well-being and social cohesion. With this volume, readers will find an answer to a problem that is both urgent and long-term, both individual and societal. The Cochabamba Water War of 2000 brought together city residents of all stripes to mobilize against water privatization and gain back public control of the city's water utility. This event catapulted anti-privatization movements around the world, but two decades later, the water movement's vision of democratic water provision remains largely unfulfilled and the city suffers from a protracted water crisis. Building a typology of participation, this book explores the difficulty in rebuilding a strong public water service in Cochabamba by analyzing the different, and often incompatible, understandings and interpretations of social control and public participation. Applying this framework to the Bolivian context, and more specifically to the water and sanitation sector in Cochabamba, the book uncovers whose interests are served, and which groups are included or excluded from decision-making and access to water. This exercise illustrates how, in their implementation, participatory practices are not linear and can be distorted or appropriated towards different ends. Mountaineering, broadly defined as hiking, trekking and climbing, is now a mass phenomenon, with continually growing numbers of trekkers, climbers and religious tourists hiking in mountain regions. Increasing visitor numbers require the current policies to be updated. The environments around high-mountain areas and their local resident communities, until recently cut off from civilisation, are sensitive to outside influences and have been abruptly exposed to the impact of mountaineering and related activities. This is the first book to disentangle overlapping terms and definitions related to mountaineering tourism. It identifies the key terms and turning points in mountaineering tourism and discusses the impacts of mountaineering tourism from an environmental, socio-cultural and personal perspective and identifies current tourism management policies. Although discourses of 'development', 'sustainability' and 'women's empowerment' are used by the investment company, the state and the customary authorities to legitimise the large-scale land acquisition, this book highlights how the deal benefits mainly the powerful elite, including elite women, and generally increases the depreciation of those already most marginalised, such as poor female-headed households and settler communities that were dependent on resources from the commons now enclosed and transformed into a rice farm. The author adopts a New Institutionalist perspective in social anthropology in order to analyse how this land acquisition has been implemented in a plural institutional context and how different actors use different rules and regulations and associated legitimating discourses to increase their bargaining power and to pursue their own interests in a changing legal context. In addition, this perspective shows how benefits and losses are distributed along different intersecting axes of power, such as class, gender, clan membership and age. By focusing on power, gender and legitimisation strategies in the context of institutional change caused by the large-scale land acquisition, this book fills a gap in the literature on large-scale land acquisitions while contributing to the development of a theoretical perspective on institutional change, power relations and ideological legitimisation.This book will be of great interest to students and scholars of land and resource grabbing, agricultural development and agribusiness, land management and development studies more broadly. 142 pp. Englisch.
