Angesichts zunehmender Konfrontation vor allem westlicher Streitkräfte mit asymmetrischer und terroristischer Kriegsführung und umstrittener militärischer Reaktionen wie der gez…ielten Tötung von Terrorverdächtigen rückt der Einsatz tödlicher Waffengewalt in extraterritorialen Einsätzen jedoch immer mehr in den Blickpunkt der Öffentlichkeit. Dies gilt für Deutschland spätestens seit dem von Bundeswehroberst Klein angeordneten Luftangriff von Kunduz vom 4. September 2009.Vor diesem Hintergrund geht der Autor der Frage nach, unter welchen Voraussetzungen und in welchen Grenzen deutsche Hoheitsträger im Ausland - die deutsche auswärtige Gewalt - zu tödlichem Waffeneinsatz berechtigt sind. Er untersucht einerseits die Rechtmäßigkeit der Entsendung militärischer und polizeilicher Operationen ins Ausland und andererseits die Rechtmäßigkeit des im Ausland erfolgenden konkreten Waffeneinsatzes - und zwar jeweils sowohl nach Maßgabe des Völkerrechts als auch nach Maßgabe des deutschen Verfassungsrechts.Der Schwerpunkt der Arbeit liegt auf der Analyse der Rechtmäßigkeit des konkreten Waffeneinsatzes. Auf der Ebene des Völkerrechts werden insbesondere aktuelle Entwicklungslinien im Recht der bewaffneten Konflikte vertieft beleuchtet. Kernstück der Untersuchung ist eine umfassende verfassungsrechtliche Auseinandersetzung mit der Frage, in welchem Umfang deutsche Hoheitsträger in Auslandssachverhalten an die Grundrechte des Grundgesetzes gebunden sind und welchen Anforderungen Rechtsgrundlagen zum extraterritorialen Grundrechtseingriff genügen müssen.Die Arbeit wurde mit der Otto-Hahn-Medaille der Max-Planck-Gesellschaft ausgezeichnet.
