Volgens de Europese Commissie staat de private handhaving nog in de kinderschoenen, wat mede zou zijn toe te schrijven aan hindernissen in de nationale rechtsstelsels. De preadviseurs menen dat de Commissie, in ieder geval voor wat betreft Nederland, een te somber beeld schetst. Er is sprake van een levendige handhavingspraktijk. Het ontbreken van zaken over mededingingsrechtelijk ingewikkelder casusposities is vooral toe te schrijven aan - mede door de Commissie zelf gecreëerde - onduidelijkheid over de inhoud van de materiële normen. Het Nederlandse civiele (proces)recht vormt daarentegen geen belemmering voor een effectieve private handhaving. Aan een (partiële) Harmonisatie van het nationale civiele (proces)recht ter bevordering van schadeclaims in mededingingszaken bestaat in de opvatting van de preadviseurs dan ook geen behoefte. Na een tweetal inleidende hoofdstukken waarin de private en de publieke handhaving tegen elkaar worden afgezet en waarin wordt stilgestaan bij materieelrechtelijke vraagstukken rond de toepassing van het mededingingsrecht door de burgerlijke rechter, gaan de preadviseurs dieper in op een aantal meer en minder controversiële civielrechtelijke vraagstukken die bij de private handhaving van het mededingingsrecht aan de orde komen.
