Paperback. Condición: New. Print on Demand. This book records the reports of land cases brought before the United States District Court for the Northern District of California between June 1853 and June 1858. The author was the judge of this court, and these reports were transcribed directly from his notes. Serving as a record of an era of immense historical change as California transitioned from Mexican rule to being part of the United States, these represent some of the earliest legal proceedings in the state. The cases in this book concern the land claims of the period, providing insights into the complex legal and political landscape of the time. The book gives an overview of how land ownership was adjudicated after the change of sovereignty and the criteria upon which the court made its decisions. It also demonstrates how the transformation of California from Mexican territory to part of the United States was not just a political change but also a legal one. This book is a reproduction of an important historical work, digitally reconstructed using state-of-the-art technology to preserve the original format. In rare cases, an imperfection in the original, such as a blemish or missing page, may be replicated in the book. print-on-demand item.

No Binding. Condición: Very Good. 5 typewritten sheets. 13 x 8 ½ inches, and one manuscript addendum sheet in Ogden Burrows' hand, 16 ½ x 5 inches. Creased at folds with some wear and toning, otherwise very good. The Burrows were a very interesting family. Ogden's father, the namesake of his son, Silas Enoch Burrows, was born in Mystic, Connecticut in 1794, he died in 1870. He amassed a huge fortune through the international shipping empire he built (he also owned a number of whaling sealing vessels) and used his wealth liberally to find and help shipwrecked mariners. One such search mission was to find Sir John Franklin's ships, the Erebus and the Terror for which he purchased two brigs with the Grinnells. In 1847, Silas E. Burrows introduced the telegraph in Russia. Ogden's daughters both married into British nobility (sometimes called "Dollar Princesses"). They are both mentioned in his will. Mary married Somerset Frederick Gough-Calthorpe 8th Baron Calthorpe, in 1891. Their only son, Frederick "Freddie" Somerset Gough-Calthorpe (1892-1935), was a first-class cricketer (best in the country), he captained England and died from cancer, age 42. Ogden's youngest child, Elsie, married Sir John Shiffner in 1894. Sir John was a veteran of the Zulu campaign in 1879. While cleaning his gun in April 1914, (preparing for an outing with his two young sons returning home from school for the Easter holidays), he accidentally shot and killed himself. The two sons were Sir John Bridger Shiffner (1899-1918), who was killed in France just 6 weeks before armistice at age 19, and Sir Henry Burrows Shiffner (1902-1941), Major, Royal Artillery, who was killed by Erwin Rommel's troops in Egypt. Signed by Author(s).

vii, [1], [9]-458; 146 pp. 8vo. First edition. First edition. vii, [1], [9]-458; 146 pp. 8vo. A crucially important and quite uncommon report on land cases in the fifteen year period after the United States took control of California. One of the most contentious issues in California legal, political, and economic history in the period was over titles to lands granted by the Spanish and Mexican governments to the "Californios" (those of Spanish or Mexican heritage who were born in or lived in California) and American residents of California. Ogden Hoffman became the first Judge of the U.S. District Court for the northern district of California in 1851, at the young age of twenty-nine. His was the most significant judicial voice in the period on land title issues and he presided over many important cases, including Jose Limantour's claim to the lands that made up San Francisco. In this volume, Hoffman presents the reports of 110 important land cases, and lists more than 800 other land claims in the appendix. "The consummate early source of information on land ownership in California from the Spanish and Mexican era" (Kurutz in Volkmann catalogue). The text also includes biographical sketches of Spanish and Mexican governors from Portola to Pico. Thomas Streeter noted that he had searched for a copy of Hoffman's reports for quite some time, but that it remained an elusive volume for him. It was only in 1957 that he acquired a copy (from Dawson's Book Shop), allowing him to complete his Zamorano 80 collection. "Though one would not suspect that this rather thick volume of reports of law cases was at all rare, it is in fact a very rare book, as well as quite an important one" (Streeter). Warren Howell, in his landmark catalogue 50, was only able to feature a modern reprint of Hoffman's Reports, calling the original work "a classic of California history." Cowan II p 287; Graff 1919; Greenwood 1654; Howes H569 "b"; Streeter sale 2874. Zamorano 80:44; Norris Catalogue 1652 Bound in original sheep with black and red morocco labels, loss at head of spine, lower label chipped with loss, worn at edges. Text toned, dampstaining.

1st Edition. 8vo., (9 x 5 4/8 inches). Original sheep, morocco lettering-pieces on the spine ( head and foot of the spine a bit worn with loss; preserved in tan calf clamshell box. Provenance: Inscribed at the head of the title-page "Judge Hester, with the regards of Frederick Billings"; with the ownership inscription of "G.A. Huneter" dated January 1879 on the front paste-down; with the bookplate of James S. Copley on the front free endpaper, his sale, Sotheby's New York "Magnificent American, Historical Documents", 10th May 2011, lot 1059. First edition, and RARE. "Though one would not suspect that this rather thick volume of reports of law cases was at all rare, it is in fact a very rare book, as well as quite an important one. For many years before the publication of The Zamorano Eighty in 1945, I had been assembling a collection of Californiana, but it was only in January, 1957, that I was able to complete my holdings of The Zamorano Eighty by the purchase of this volume.-TWS." Judge Hoffman's work is an early source of information on land ownership in California from the Spanish and Mexican era. The "Reports of Land Cases" contains the decisions Hoffman made on appeals from the Board of Land Commissioners contains valuable information on nearly every major land grant bestowed by Spanish and Mexican governors. Hoffman records 110 cases, and an appendix listing 813 land claims filed with the Land Commission, and provides an important perspective on the Californios' struggle to hold on to their ranchos before courts with little knowledge or sympathy for Mexican law and customs. Hoffman as the first Judge of the U.S. District Court for the northern district of California, he presided over the most important decisions concerning land ownership in California history, including the celebrated case of José Y. Limantour case, in which the Frenchman fraudulently claimed 15,000 acres of the city of San Francisco and the islands of San Francisco Bay. Hoffman's opinion was published separately as a fifty-eight-page pamphlet in 1858. At the time of his death in 1891, Hoffman had served forty years on the bench and was acclaimed as one of California's greatest judges. From the legal library of Frederick Billings, who came to San Francisco in 1849 and with Henry W. Halleck and Archibald Peachy established the state's leading law firm; he later served as California's Attorney General, and built the Northern Pacific RR. Billings, Montana is named for him. Cowan II, p. 287; Graff 1919; Howes H569. Catalogued by Kate Hunter.
