Añadir al carritoWrappers. Octavo. 132 pages. Frustrated by Rhode Island's outdated landed property ownership requirement for voting, and by the inability to change the system legislatively, Thomas Dorr and his supporters essentially tried to set up a separate state government and capture the arsenal at Providence. These efforts were thwarted by Governor Samuel Ward King and the Charter government. Dorr was arrested and tried for treason. This is a record of the trial testimony and verdict. Despite his setbacks, Dorr's efforts resulted in Rhode Island's adoption of a new constitution in 1842 which removed the property restriction and otherwise greatly liberalized voting requirements in the state. Very Good+. Original printed salmon-colored wraps over sewn binding, with minor edge rubs, a diagonal crease to lower fore corner of front cover, and short separations of covers at spine ends. Some foxing to first and last leaves. …

Añadir al carrito56pp, stitched, original printed wrappers [minor extremity wear, spine wear]. Else Near Fine. The constitutionality of Rhode Island's Charter government, as well as the Dorr Constitution, reached the Supreme Court after Martin Luther, a Dorr "insurgent," challenged the authority of the existing Rhode Island government to declare martial law and arrest him. He argued that the Charter had been abolished by the Dorr Constitution and that, indeed, the insurgents were authorized to overthrow the existing government "by force of arms." Whipple provides a detailed history of the Charter government, the Constitutions purportedly superseding the Charter, and of the Dorr Rebellion. His argument opposes "the wild, visionary and revolutionary theories" of the Dorrites. Webster argues that bedrock "principles of public liberty" prevent the establishment of a new constitution by extra-constitutional means. Although "the will of the people must prevail.there must be some legal and authentic mode of ascertaining that will." II Harv. Law Cat. 1133. Cohen, BEAL 12004. Sabin 70732.…

Añadir al carritoFirst Edition. 12mo (19.5cm). Brown cloth, titled in gilt on spine; plain endpapers; [i]-xii [13]-324pp; steel-engraved frontispiece with tissue guard. A straight, bright copy, cloth just lightly worn; two small damp-stains to front endpapers and mild foxing to the frontispiece portrait of Dorr; Very Good. The work has been attributed to both Frances Harriet Greene and to Catherine R. Williams. A quite radical contemporary account of the mid-nineteenth-century Rhode Island universal suffrage movement and the 1841-1842 Dorr Rebellion, when Thomas Dorr led disenfranchised Rhode Islanders in an attempt to demand changed electoral rules and broader democracy. The author explicitly allies the Dorrites to fellow worker's rebellions in America and Europe, characterizing these movements as a class war whose time has come: ".The spirit of the age will not long permit some men to live sumptuously, and fatten on the labor of others while the poor laborer, himself, is starving. The days of their wrong are numbered. They must be weighed in the balance, and found wanting; and their kingdom shall be divided. The repealers of Ireland, the Chartists of England, the Free Suffrage men of Rhode Island, are awake, and acting." A second edition, containing a new Appendix, was issued in the same year. Añadir al carritoBroadside, 8-1/4" x 9-1/4." Two columns of text printed beneath boldly printed title. Mild uniform toning, Very Good plus. Signed in type at the end by Cyrus Butler of Brown & Ives. "Dated at Providence, March 29, 1843." A contemptuous refutation of the claim of "the Dorrites, that the State is indebted on account of the late insurrection, $500,000-- for expenses of the Quarter Master's and Commissary's Departments, and for money borrowed of Messrs. Brown & Ives and Cyrus Butler, of Providence." In fact, however, "the true statement of the costs of the Dorrite war" is only "the sum of $5000." The difference between $5,000 and $500,000 is "what the Dorrites will claim and have of the State themselves, if you give them the power by supporting the falsely called Democratic Ticket." Supporting data from the Commissary General and Quarter-Master General demolish the false claims. DeSimone & Schofield 1. OCLC records six locations under three accession numbers as of July 2022.…

Añadir al carritoSmall oblong printed certificate, 2.5" x 5.75". Printed on light stock. Clean. Fine. An ephemeral document from the Dorr Rebellion, which began as a peaceful attempt to replace the archaic, undemocratic Rhode Island Charter with a written constitution broadening the suffrage. In 1842 frustrated Dorrites took up arms and were met by force. For participating in the uprising, Martin Luther was arrested in 1842 by Luther Borden, a militiaman. Claiming that Borden acted without authority, Luther took the case to the U.S. Supreme Court. He argued that the Dorr Constitution displaced the Charter because the Charter flunked the U.S. Constitution's Article Four, Section Four, which guarantees to every State "a Republican Form of Government." But in Luther v. Borden, 48 U.S. 1 [1849], Chief Justice Taney ducked the issue by calling it a 'political question,' and thus out of bounds for the Court to decide. Añadir al carrito15, [1 blank] pp. Caption title [as issued]. A few light fox marks, disbound, Very Good plus. The Address is signed at page 12 in type by Nehemiah Knight, formerly Rhode Island's Governor, U.S. Senator, and delegate to its Constitutional Convention; William Sprague, John Whipple, and twenty other leaders of Rhode Island's established order. Opposing Thomas Dorr and his "People's Constitution," they explain the fairness of the officially proposed Constitution, the unreasonable stance of the Dorrites, and their willingness to plunge the State "into all the horrors of civil war." They delineate the utter absence of authority for Dorr to exercise "the office of Governor under a pretended Constitution," describe the insurrection which he led and the "grossest frauds" which Dorrites perpetrated in the votes for the Dorr Constitution, and the observance of all legal formalities in Dorr's trial and conviction. The pamphlet does not end at page 12, although some incomplete copies reside in several institutions. Pages 13-15 print documents which "show that T.W. Dorr was willing to go to the State Prison rather than take an oath to support the Constitution of the State." The several documents include a report by Richard Randolph of his interview with Dorr, who indicated his refusal to take the requisite oath. Sabin 432. AI 44-54, 44-55.…

The suffrage provisions of the People's Constitution are compared with those of the "regular legal constitution," to the great detriment of the former. Under the "so-called People's Constitution, the whole body of naturalized foreigners in this State, amounting to several THOUSANDS, are placed on an equality with our native born citizens. In other words, the foreign population will govern the State, and they will govern it in all time!" Opinions of the Justices of the State Supreme Court and the State Attorney General are printed declaring the People's Constitution void. To support it "is Treason against the State." Cohen 3294. Añadir al carritoBroadside, 8" x 11". Light dusting and wear, Good+. The broadside, opposing the Dorrites, prints Jonah Titus's 1842 letter to Rhode Island Governor King withdrawing his candidacy for Attorney General on the Dorr Ticket "under the so-called 'People's Constitution'." Titus has taken to heart President Tyler's admonition that federal troops will be deployed to assist the Charter Government, on the ground that the People's Constitution is illegitimate. He thus has decided not to put at risk "the peace and happiness of my adopted State." "Mr. Titus comes to the same conclusion as any honest and peaceable citizen." Yet the Dorrites have kept his name on their ticket, and continue to threaten the use of military force against the established, legitimate government. The broadside urges "every good citizen" to follow Titus's "patriotic example-- and thus avoid the tremendous consequences that must and will follow a gross violation of the laws." Our Dorr expert, Russ DeSimone, has written about the controversy and this broadside at length. DeSimone, RHODE ISLAND'S REBELLION. NUMBER TWO, pages 11-13. Añadir al carritoBroadside, 11-1/2" x 20". Printed in three columns. Woodcut illustration of Rhode Island seal, with the word 'Hope' printed at head of title. Old light folds, several fox spots. Good+. Governor King's folio broadside publishes President Tyler's Letter of April 11, 1842, promising that American troops would support Rhode Island's regular government against insurgent Dorrites; and John Whipple's Letter warning that, if the Dorrites succeed, "the same sure law of force will inevitably prostrate every State Government in the Union." Whipple led the anti-Dorr Party. "The Dorr Rebellion focused national attention on the question whether or not a majority of the people may rightfully frame a new government regardless of the provisions of the constituted government. Leaders of the disfranchised populace in Rhode Island had met and framed a 'People's Constitution' and proceeded to elect a government independent of the incumbent regime" [Peterson, The Great Triumvirate 338]. Acting under his constitutional duty to "guaranty to every State in this Union a republican form of government", Tyler asserted that the United States would continue to recognize "the existing Government of the State" as the lawful government of Rhode Island "until I shall be advised in regular manner, that it has been altered and abolished, and another substituted in its place, by legal and peaceable proceedings." Añadir al carritoBroadside, 8 1/2" x 11 3/4". Light spotting, trimmed a bit unevenly, Very Good. This rare broadside is an attack on the Dorrites and their 1843 candidate for Governor, General Thomas Carpenter, who is unprincipled and "all things to all men." Seeking to skirt the Algerine Law, which classified Dorrites as traitors, Carpenter and his colleagues "are willing to say or do any and promise any thing in order to get themselves into office." The broadside quotes inconsistent "resolutions passed at some of the late Dorrite meetings"; and warns, "Do you wish to see the People's Constitution forced upon you? Do you wish to see the State flooded, and your elections controlled by, Irishmen and Foreigners, which it certainly will be if that party prevails and adopts that Constitution."
