Erste Ausgabe des ersten teiles des großen, fallorientierten Kommentars zum sächsischen Gesetzbuch von Berlich, dem Vorgänger Carpzovs! Mat…thias Berlich (1586 - 1631), Advokat und Professor zu Leipzig, gilt als Wegbereiter von Benedict Carpzov: "nisi Berlichius berlichizasset, Carpzo- vius non carpzoviasset". Zusammen mit Carpzov und Berlichius steuerte die sächsische Rechtswissenschaft einem Standard entgegen, aufgrund dessen sie als die bestimmende Rechtsdoktrin nicht nur im nord- und mitteldeutschen Raum angesehen werden kann. Besonders in der Verbindung von Theorie und Praxis dämmte die sächsiche Rechtswissenschaft die italienischen Einflüsse weitgehend zurück und initiierte damit eine eigenständige deutsche Rechtswissenschaft. Dies galt insbesondere für die deutsche Straf- und Prozeßrechtswissenschaft. Berlich zeigt in seinem Hauptwerk die große Bedeutung der kursächsischen Konstitutionen von 1572 auf, deren Kommentierungen hier vorgenommen und deren eigenwillige Systematik übernommen wird. Im Gegensatz zu Carpzov steht Berlich jedoch noch weitgehend stark unter romanistischem Einfluß. Innerhalb des sächsischen Raumes muß Berlich als einer der bedeutendsten Juristen eingestuft werden. Das Werk entstand, so Berlich in seinem Vorwort, auf Betreiben seines Schwiegervaters, des Leipziger Druckers Henning Gross, der beklagte, dass die Berartungen zu den kursächsischen Konstitutionen von 1572 (ohne Erlaubnis) in mainz erschienen sind. Diese Edition sei jedoch "konfur und fehlerhaft". Gross wollte seinen Schwiegersohn gewinnen, die einzelnen entschiedenen Fälle gelehrt und systematisch darzustellen:; a ma cupiit ut hunc laborem in me susciperem, in utilitate Reipublicae & usum studiosae juventutis . in ordinem methodicum, quam brevissime fieri posset. Also methodisch geordnet und schnellstmöglich. Als Berlich sich an die Arbeit machte, berücksichtigte er auch die bislang zu den kusräschsischen Konstitutionen publizierten Entscheidungen, gesammelt vor allem von Modestinus Pistoris und Thomingius, Colerus und Köppen. Berlich hat aber auch die Bezüge zum Ius Commune gesucht und entsprechend Literatur und Gesetzesquellen zitiert.

Erste vom Leipziger Rechtsgelehrten Schwendendörffer (1631 - 1705) herausgegebene Ausgabe. Berühmter Kommentar zum einzigen deutschen Case-law-book! Die kursächsischen Konstitutionen war ein Gesetzeswerk, daß in der Geschichte der deutschen Gesetzgebung einmalig gewesen ist. Es ist keine Kodifikation im herkömmlichen Sinne, sondern ein Sammelband von auf dem legislativen Wege entschiedenen Rechtsfällen, also ein Art von deutschem "case law". Dies zeigt die ungeheure Dominanz forensischer Jurisprudenz in Sachsen. Dort entwickelte sich seit dem 16. Jahrhundert eine mächtige Rechtsprechung, vor allem an den Obergerichten zu Jena, Wittenberg und Leipzig. Natürlich traten bei wichtigen Rechtsfragen oft entscheidende Unterschiede auf. Dies abweichenden dogmatischen Standpunkte wurden nicht von einem BGH, sondern mittels Konferenzen, letztlich durch einen legislativen Akt entschieden. Die daraus entstanden kursächsischen Konstitutionen enthalten diese entschiedenen Rechtsfälle. Matthias BERLICH (1586-1638), ADvokat und Professor zu Leipzig, verfaßte den ersten vollständigen Kommentar zu den kursächsischen Konstitutionen. Berlichgilt als Wegbereiter von Benedict Carpzov: "nisi Berlichius berlichizasset, Carpzovius non carpzoviasset". The cover is rubbed, slightly stained, the narrow spine toward the upper capital is inscribed "Matthias Berlichius" in an old hand, clasps are missing, corners and edges bumped. The unprinted endpapers are missing inside; the first approximately 21 pages are slightly worm-eaten toward the white outer margin (without loss of letters), as are the last 10 pages. The back cover is somewhat worm-eaten. Some of the interior pages are slightly foxed or finger-stained (some pages more heavily foxed), some pages have slight brown stains, and the paper is partially browned. Matthias Berlich (1586 - 1638) "studierte Rechtswissenschaft in Jena, später unter Hermann Vultejus in Marburg und promovierte hier 1610 zum Dr. jur.; 1611 machte er sich in Leipzig ansässig und wurde dort ein berühmter Anwalt und Konsulent; er hielt zugleich juristische Privatvorlesungengen. Sein Wissen… und seine Belesenheit im juristischen Schrifttum waren nach zeitgenössischen Berichten außerordentlich. Seine größte Wirkung erreichte er durch die `Conclusiones practicabiles` (5 Bände, Leipzig 1615 bis 1619, später mindestens 11mal neu herausgegeben, zuletzt 1739), eine Darstellung des gemeinen Rechtes nach der Ordnung der sächsischen Konstitutionen von 1572. Beide Rechtsquellen werden unter Anführung praktischer Beispiele aus der Rechtsprechung zueinander in Beziehung gesetzt. Matthias Berlich hat Benedikt Carpzow teilweise vorgearbeitet, im Strafrecht insbesondere dadurch, daß er die einzelnen Verbrechenstatbestände genauer umschrieb.
