The Court, he warns, has assumed an extraordinary role--that of the nation's paramount policymaker, a super-legislature. Berger documents the narrow aim of those who framed the 14th Amendment and shows that the three clauses of the Amendment--privileges or immunities, due process of law, and equal protection---were designed to describe and implement these rights.
