This book thoroughly examines the legal concept of "benefice of inventory" in the context of French civil code, which allows heirs to accept an inheritance while limiting their liability to the value of the estate. This approach stands in contrast to the common law concept of "pure and simple acceptance," which renders the inheritor fully liable for all debts and charges associated with the estate, even if this exceeds its value. The author traces the history of the "benefice of inventory" back to Roman law, and analyzes how it was incorporated into French law and jurisprudence, eventually finding its way into the modern Civil Code. The book also explores the practical implications of the "benefice of inventory," including the conditions and formalities that must be met in order to invoke it, the effects it has on the administration of the estate, and the potential conflicts that can arise between heirs and creditors.
