Hardcover. Condición: Near Fine. No Jacket. 1st Edition. Hardcover without dust jacket. Yellow Covers with black & white design and black lettering. Pages clean and unmarked. Book in near fine condition. How do societies at the national and international level try to overcome historical injustices? What remedies did they develop to do justice to victims of large-scale atrocities? And even more important: what have we learned from the implementation of these so-called instruments of transitional justice in practice? Lawyers, socials scientists and historians have published shelves full of books and articles on how to confront the past through international criminal tribunals, truth commissions, financial compensation schemes and other instruments of retributive/punitive and restorative justice. A serious problem continues to be that broad interdisciplinary accounts that include both categories of measures are still hardly available. With this volume a group of international experts in the field endeavors to fill this gap, and even more. By alternating historical overviews with critical assessments this volume does not only offer an extensive introduction to the world of transitional justice, but also food for thought concerning the effectiveness of the remedies it offers to face the past successfully. …

Paperback. Condición: new. Paperback. Climate change litigation is emerging as a global response to the unfolding climate crisis. As global warming increases and the catastrophic consequences of climate change become apparent, individuals and civil society as a whole are increasingly looking to the judiciary to uphold public and private entities' obligations to fight global warming and step-up actions to protect present and future generations. Climate change litigation is particularly pertinent in Europe. Since the landmark decision in Urgenda v. The Kingdom of The Netherlands in 2015, climate cases have been filed across European jurisdictions and reaching European regional courts, such as the Court of Justice of the European Union and the European Court of Human Rights. Consequently, climate change litigation is also emerging as a consolidated body of knowledge and practices, with the common objective of enhancing climate change mitigation and adaptation action. It is a multi-faceted phenomenon, engaging with a wide array of substantive and procedural legal challenges and issues. Legal architectures and strategies for climate cases include, among others, environmental law, tort law, constitutional law, consumer law, administrative law and human rights law.Against such a backdrop, Climate Change Litigation in Europe provides, for the first time, a comprehensive account of the most relevant developments around climate change litigation, with a specific focus on Europe. To this end, the book aims to address the phenomenon of climate change litigation from a threefold perspective. First, it unpacks the supranational dimension of climate change litigation within Europe, with a particular focus on European regional courts. Second, it provides a comparative analysis of climate change litigation from different European jurisdictions, in order to understand points of convergence and departures among the different approaches to the common problem of tackling global warming. Finally, it analyses relevant substantive and procedural issues underpinning both existing and future climate change litigation, ranging from human rights to state and corporate responsibilities, international trade and investment and procedural rights. The book comprises contributions from highly experienced law practitioners and academics, as well as emerging and established experts in the field of climate law and environmental law. It contributes meaningfully to the burgeoning body of literature on climate change litigation by providing a fully-fledged picture of this global phenomenon within Europe.About the Editors Ivano Alogna is the Research Leader in Environmental and Climate Change Law at the British Institute of International and Comparative Law (BIICL) and leads BIICL's programme in this field. He is an associate member of the Sorbonne Research Institute in International and European Law (IREDIES), Sorbonne Law School. He is also a member of the World Commission on Environmental Law (WCEL) of the International Union for the Conservation of Nature (IUCN) and its Climate Change Expert Group, a member of the WCEL Taskforce on the Rights of Nature, and an expert of the 'Environmental Law and Policy' Commission, IUCN French Committee. He was the General Rapporteur of the 'Global Pact for the Environment' project (French Constitutional Council and Club des Juristes) and a member of the European Law Institute (ELI) project on 'Ecocide'. Furthermore, he is a licensed attorney-at-law at the Bar of Milan. Ivano lectures on international and comparative environmental law, climate change law and litigation, environmental liability, private law, sustainable consumer law and comparative law. He is the co-editor of the book Climate Change Litigation: Global Perspectives (2021, Brill). Hardcover. Condición: new. Hardcover. The 'Brussels II' Regulations have a long history and provide the EU's rules on jurisdiction, recognition and enforcement of matrimonial matters, matters of parental responsibility, and international child abduction. In 2016, the EU Commission published its Proposal for recasting what was then Council Regulation No 2201/2003 ('Brussels II-bis'). There followed lengthy negotiations that resulted in the recast Council Regulation No 2019/1111 ('Brussels II-ter'), which came into force in August 2022. Brussels II-ter has made substantial changes. Brussels II-ter is the key EU instrument for dealing with cross-border issues involving recognition of divorce, custody and access disputes over children, international abduction and the placement of children from one Member State to another. This book provides an in-depth discussion of this complex Regulation. Written by three renowned experts, this comprehensive analysis benefits from the collective scope of their experience and knowledge, not only of their respective jurisdictions (Italy, Sweden and the UK) but also more generally of international family law and private international law. Brussels II-ter: Cross-border Marriage Dissolution, Parental Responsibility Disputes and Child Abduction in the EU provides not only a clear exposition of the Regulation's provisions, but also a critical evaluation of them. Rather than an Article-by-Article analysis, the book instead comprises separate chapters on discrete parts covered by the Regulation--namely, on the history and scope of Brussels II-ter; common rules on court proceedings; jurisdiction in matrimonial matters; parental responsibility; coordination of proceedings; international child abduction; the hearing of the child; recognition, enforcement, authentic instruments and agreements; and cooperation in matters of parental responsibility. An exposition of the relationship between the EU and the UK following Brexit concludes this volume, which discusses, among other issues, the often problematic inter-relationship between Brussels II-ter and the 1996 Hague Child Protection Convention. The book provides indispensable reading for those who will have to apply the Regulation, such as judges and practitioners, and students who want a clear history, scope and analysis of the Regulation and its impact on the field of cross-border family law. About the Authors Nigel Lowe KC (Hon), LLB, LLD, Barrister, is an Emeritus Professor of Law at Cardiff University, UK. He is a well-known expert in international family law, particularly cross-border disputes concerning children, on which he has written extensively. His work is cited in courts and in academic literature around the world. Nigel was a member of the Expert Group assisting the EU Commission on the Recast of Brussels II-bis Regulation (2015), as well as the UK International Family Law Committee, and acts as a Sometime Consultant to the Permanent Bureau of the Hague Conference on Private International Law and the Council of Europe. Costanza Honorati, Dr., is a Professor of European Union Law at the Milano-Bicocca University's School of Law, where she also holds the position of Chair of EU Private International Law. She was a member of the Expert Group assisting the EU Commission on the Recast of the Brussels IIa Regulation (2015-2017) and the Chair of the Commission's EJN Working Group on a Guide to the Maintenance Regulation (2019-2022). Costanza has written extensively in the field of European private international law, and in the last years mostly--but not exclusively--in family law matters.
