Paperback. Condición: New. Legal Cases that Changed Ireland examines key legal cases which have brought about significant social change in Ireland. The book is based on the 2015 project, entitled 'Changing Ireland, Changing Law, ' which involved a series of seminars under four themes exploring the relationship between legal action and social change. The four themes included: Women Changing Law, Changing Society; Sexual Identity, Law and Social Change; Immigration, Asylum and Legal Change; and Public Interest Litigation: Does it Work? Under each theme, a perspective is also provided by key non-governmental organizations that supported or initiated strategic legal cases, namely the Public Interest Law Alliance, the National Women's Council of Ireland, the Gay and Lesbian Equality Network, and the Immigrant Council of Ireland. While the changing nature of society is evident every day in our courtrooms, it is only in exceptional cases that we hear the stories behind moments of legal change. This book documents not only the stories of the legal cases themselves, but also the experiences of individuals who have taken cases of social importance.Recognizing that it is not only cases heard in the superior courts resulting in judgments pored over by constitutional lawyers than can shape people's lives in profound ways, this book also supports the sharing of experiences of cases in other legal venues, such as the Equality Tribunal. These stories assist us to understand more about the nature of legal processes. [Subject: Irish Law, Legal History.

Paperback. Condición: New. Legal Research and Writing Skills in Ireland offers an easy-to-use and accessible guide on the core legal skills of research and writing. While Legal Research and Writing Skills in Ireland is specifically tailored to developing these skills in an Irish context, much of the information included in this book will be of value to a reader outside of Ireland as well. Using worked examples and practical tips, this book guides the reader through the stages of undertaking a piece of legal writing. It does this in three parts. Part I condenses and clarifies the research process by discussing research planning and how to find sources of legal information. Part II delves into the writing process and offers advice and tips on good writing generally and effective legal writing specifically. It also includes guidance on how to cite your sources. Finally, Part III combines the skills discussed in Parts I and II and applies these to practical situations in which legal research and writing will be relevant. In doing so it discusses, and provides practical tips on, how to plan and write a dissertation proposal, how to tackle a written assignment, the elements and structure of effective emails and letters, and the written portion of a presentation.

Paperback. Condición: New. Art and cultural heritage law is a well-established practice area internationally but still in its infancy in Ireland. With the passing of the Historic and Archaeological Heritage and Miscellaneous Provisions Act 2023, Ireland is poised to accede to the 1995 UNIDROIT Convention on Stolen or Illegally Exported Cultural Objects and to ratify the 1970 UNESCO Convention on the Means of Prohibiting and Preventing the Illicit Import, Export and Transfer of Ownership of Cultural Property. There is increasing scrutiny of the provenance of 19th century collections in Irish institutions, in particular ethnographic items. New pressures are being applied to galleries, libraries, archives and museums ('GLAM') to fully catalogue their extensive holdings to prevent loss while also being expected to digitise and open access to their material, while ensuring compliance with copyright, GDPR and artists moral rights.GLAM bodies must also interact with contract law, deposit, loan and gift agreements, tax law and customs and import and export restrictions, while often operating without in-house counsel.Art and Cultural Heritage Law: A Practical Guide takes a pragmatic approach to explaining legal issues to GLAM professionals, and art and cultural heritage issues to legal practitioners.

Paperback. Condición: New. The distillation (sometimes illegal) of uisce beatha, poitín and gin has existed in Ireland over many centuries. In 1806, over 25% of the entire production of Irish whiskey was estimated to come from illicit stills. While the process of brewing and distilling has come a long way since the days Molly Gallivan produced her homemade poitín known as Molly's Mountain Dew in the Kerry Mountains, laws from 1831 still apply to breweries and distilleries today. In 1887, the annual output of whiskey manufactured in Ireland was 10,620,584 gallons. There were many thriving distilleries in Dublin and Cork, and in Tullamore and Kilbeggan, and elsewhere, many of which still survive and are indeed thriving today. As of June 2019, Ireland has twenty-five distilleries in operation, with a further twenty-four either planned or under development. As of 2018, sales of Irish whiskey stood at 10.7 million 9-litres cases, up from 4.4 million cases in 2008, with sales projected to exceed 12 million cases (its historical peak) by 2020.Brewers and Distillers in Ireland: The Complete Licensing Guide discusses all the different types of manufacturers' licences, the rights and obligations of the manufacturer and how to obtain a manufacturer's licence from Revenue. The sale of the manufactured product by wholesale is also discussed, as is its retail sale, which was introduced for the first time by the Act of 2018.Differing permitted hours for on-sales and off-sales are discussed, as are offences and penalties. The Intoxicating Liquor (Breweries and Distilleries) Act 2018 has allowed for the first time the retail sale of alcohol (spirits and/or beer) on the premises where such alcohol is manufactured.

Paperback. Condición: New. Each manager of a department, or a specific responsibility, must assess the data issues and risks asare relevant to their individual department. The manager must assess what data exists; whether it ispermitted for use; filter out (including deletion of) data that is over-broad or otherwise not permitted;and ensuring procedures to identify and eliminate processes that open up the risk of future unjustifieddata collections. While other agents of the company or organisation will have responsibilities inrelation to data protection compliance, the manager of a department must also engage in bestpractices that focus on the data protection obligations of the department. Data protection compliancerequires not just adherence to specific data protection legal provisions, but a full understanding ofwhat data exists in the department, company or organisation, where it is located and for whatpurpose. The personnel manager needs to be satisfied that all of the internal personnel records are fully dataprotection complaint. Just one of the dangers is that these issues are not addressed in appropriatereviews, contracts and policies. Another risk gap is that there may be policies, etc., but the manageromitted to appropriately include other non full time employees, such as those whom may becontractors, temporary staff, interns, or family members. The marketing manager needs to be satisfied that all of the current and proposed marketing activities, customer lists, and user lists are all compliant with the new data protection rules.Organisations should have undergone an A - Z review of data protection compliance in the lead up tothe new EU General Data Protection Regulation (GDPR) go-live date. In many organisations there willbe many activities and actions which carried over from the GDPR review. These need to continue tobe actioned. In addition, there is also a new Data Protection Act 2018 to consider.Organisations should also have appointed a new Data Protection Officer (DPO) to assist in theseefforts and to be the official point of contact internally and externally (for data protection supervisoryauthorities and for customers and users).Critically, all Managers need to be aware of data protection compliance and related issues within theirown Department. The Manager has duties and responsibilities. The Manager cannot simply assume that someone else will do it, or that all data protection issues fortheir Department are already being dealt with by the DPO or some other Department.

Paperback. Condición: New. In Applied Jurisprudence and Principles of Legal Practice, Albert Keating argues that substantive jurisprudence may be extended to include concepts of applied jurisprudence and principles of legal practice. He advances his argument by asserting that the first task of applied jurisprudence is to identify the basic law of the constitution of a legal system by the application of naturalist and positivist principles. The second task is to identify the sources of law at play in the system, and this includes interpretative sources, which may be ranked as primary, secondary and tertiary sources of law. Interpretative sources also consist of tests and criteria formulated by the courts out of former decisions, and applied to current contentious matters of the same kind. The jurisprudential process of conceptualisation may also be adopted and applied when formulating concepts out of a fusion of rules, duties, and rights, and illustrates this by formulating a concept of a will fashioned out of a fusion of the validity rules of wills, duties of executors and succession rights of beneficiaries. Determinant factors may also be employed for the purposes of devising formulae for use in legal practice, and for identifying the correct legal procedures for use in applications to the courts. [Subject: Applied Jurisprudence, Law].

Paperback. Condición: New. The methodological approach and methods used in any particular research project are key to its success. In Legal Research Methods: Principles and Practicalities (Clarus Press, 2016), the contributors assessed the relative utility of a variety of methods and methodologies in the context of legal research generally. Taking a case studies approach, contributors to this text have written about the methods used in a particular piece of research, outlining the justification for the choice of that methodology; describing the methods used; detailing the advantages, disadvantages and challenges to the approach taken; discussing any ethical considerations that arose in the context of the research; reflecting on the approach taken; and concluding with advice to scholars engaging with similar methods or methodologies. Each chapter is structured in the same way in order to allow for ease of comparison between the approaches taken.

Jurisprudence, Fourth Edition commences with a comprehensive and in-depthaccount of the three main sources of jurisprudence: classical jurisprudence, substantive jurisprudence and adjunctive jurisprudence. Substantive jurisprudence as the primary source ofjurisprudence is comprised of the modern theories of naturalism and positivism, the juristic theories of Ronald Dworkin and American legal theory. Adjunctivejurisprudence as a secondary source of jurisprudence is comprised of socio-legaltheory and historico-legal theory save only insofar as those theories recognise lawas a social or historical phenomenon. This book also introduces and develops a new analytical concept of jurisprudencecalled the concept of juristic practice. This new concept may be applied whenundertaking jurisprudential analyses of legal systems.

Paperback. Condición: New. Drawing on the authors' extensive experience of working in the criminal justice and penal systems, this book presents a clear description and analysis of the stages and components of probation and parole work. Probation and parole are two vital components of any criminal justice system. Practitioners working in both are responsible for the assessment and supervision of those members of society who have committed criminal offences and are subject to court-ordered penal sanction. Those working in probation and parole must bring a range of knowledge and skills to bear in their daily work: championing community safety and justice, promoting offender reintegration, and seeking to reduce offending and the harm it causes. All of that practice is in turn underpinned by law. Professional practice in probation and parole is also increasingly informed by research findings regarding 'what works' and indeed 'who works.'.
