Druck auf Anfrage Neuware - Printed after ordering - Studienarbeit aus dem Jahr 2008 im Fachbereich Geschichte Europa - Deutschland - Neuere Geschichte, Note: 1,3, Universität der Bundeswehr München, Neubiberg (Fakultät für Staats- und Sozialwissenschaften), Veranstaltung: Werden des modernen Staates und der Staatenwelt, Sprache: Deutsch, Abstract: Zwischen zwei der, für die Deutschen wichtigsten Schlachten gegen das Napoleonische Heer, nämlich bei Jena und Auerstedt im Oktober 1806 und der Völkerschlacht bei Leipzig 1813, lag eine Zeit, die viele Deutsche als dunkle Zeit betrachten. Es kämpften in dieser Zeit nämlich so gut wie alle deutschen Staaten auf Seite Napoleons, der als Besetzer über Europa kam. In genau diesem Licht erscheint auch der Rheinbund, das Bündnis der deutschen Staaten mit Napoleon, gegen das sich ab 1808 nur Österreich, Preußen, das Herzogtum Holstein (dänisch) und Schwedisch-Pommern stellten.Doch bietet diese Zeit neben der Schmach auch andere Betrachtungsspielräume. Zum einen bot der neugewonnene Handlungsspielraum, den die Fürsten nach der Lossagung vom Alten Reich hatten, die Möglichkeit längst überfällige Reformen nach den Vorbildern Frankreichs und Preußens durchzusetzen. Beispiele für diese sind unter anderem das Novemberedikt in Baden die teilweise Abschaffung der Patrimonialgerichte, auf die später noch näher eingegangen wird, oder die Anfänge der Zollvereinspolitik, welche ohne Zweifel die spätere industrielle Revolution mit vorbereitete.Zum anderen war der Rheinbund jedoch neben den Reformen in der Hauptsache durch die Kräfte der Machtumwälzung geprägt. In der Zeit, in der ganz Europa im Umsturz war, versuchten die deutschen Fürsten ihre im Heiligen Römischen Reich Deutscher Nation (HRRDN) verlorengegangene Souveränität wiederzuerlangen. Sie wussten aber gleichwohl, dass diese nur ein Zugeständnis Napoleons war, welches er nach eigenem Belieben gewähren und nehmen konnte. Genau diese 'Souveränität' soll das Thema dieser Arbeit sein. Dargestellt werden soll ob die Souveränität, von der in der Rheinbundakte gesprochen wird, real war, oder doch vielmehr ein politischer Begriff, der nie Realität wurde. Dazu wird zunächst die Entstehung des Rheinbundes vorgestellt, um die Motive der Fürsten für (diesen Bund)deutlich zu machen. Dann wird die 'Rheinbundakte', der zwischen dem Bevollmächtigten des französischen Kaisers und den sechszehn deutschen Fürsten geschlossene völkerrechtliche Vertrag, betrachtet und anhand ihrer Artikel auf die von ihr beabsichtigte Verteilung der Souveränität hin untersucht. Danach wird die Souveränität der Fürsten im völkerrechtlichen Sinne, also einmal nach außen, sowie auch nach innen geprüft und abschließend einer resümierenden Betrachtung unterzogen.
