General Terms and Conditions (GTC)
§ 1 Scope and Provider
(1) These General Terms and Conditions (hereinafter "GTC") apply to all purchase contracts concluded between you as the customer (consumer or business) and us, the provider SmartBookDeals (hereinafter "Seller"), via the online sales platform AbeBooks (https://IberLibro).
(2) Deviating, conflicting, or supplementary terms and conditions of the customer shall not become part of the contract unless their validity is expressly agreed to in writing.
(3) For the purposes of these GTC, a consumer is any natural person who enters into a legal transaction for purposes that are predominantly outside their trade, business, or profession. A business is a natural or legal person, or a partnership with legal capacity, who, when entering into a legal transaction, acts in the exercise of their trade, business, or profession.
§ 2 Conclusion of Contract and Technical Steps
(1) The activation and presentation of goods (books, media, etc.) on the AbeBooks platform does not constitute a binding offer to sell on the part of the Seller. It is merely an invitation to the customer to submit a binding offer to purchase (a so-called "invitatio ad offerendum").
(2) The customer may submit an offer via the integrated shopping cart and ordering system of AbeBooks. After selecting the goods and entering the required order details, the customer submits a legally binding offer to purchase the items in the shopping cart by clicking the button that completes the ordering process ("Buy Now" / "Order with obligation to pay").
(3) The Seller may accept the customer's offer within three business days by:
sending the customer a written order confirmation or a confirmation in text form (e-mail), whereby receipt of the confirmation by the customer is decisive; or
delivering the ordered goods to the customer, whereby receipt of the goods by the customer is decisive; or
requesting payment from the customer after the order has been placed (e.g. for the payment method advance payment/bank transfer).
The automatically generated e-mail ("order confirmation") sent immediately after the order is submitted via the AbeBooks system merely documents receipt of the order and expressly does not constitute acceptance of the offer to purchase. The purchase contract is only concluded upon fulfilment of one of the aforementioned conditions.
§ 3 Prices, Shipping Costs, and Payment Terms
(1) The prices stated in the respective listings are final prices. They include all price components, including statutory German VAT.
Due to the application of the small business regulation pursuant to § 19 of the German VAT Act (UStG), no VAT is charged and is therefore not shown on invoices.
(2) Delivery and shipping costs are not included in the purchase price. They are shown explicitly in the respective product listing or separately during the ordering process, and are to be borne additionally by the customer, unless free delivery has been promised.
(3) The customer may use the payment methods provided in the Seller's specific offer (e.g. advance payment by bank transfer, PayPal, payment on invoice). Unless stated otherwise for individual payment methods, payment claims arising from the concluded contract are due immediately.
§ 4 Delivery and Shipping Terms
(1) Delivery of goods is made by mail to the delivery address specified by the customer during the ordering process, unless otherwise agreed.
(2) Unless a different period is stated in the item description, delivery takes place within 3 to 5 business days. The delivery period begins, in the case of payment by advance payment (bank transfer), on the day after the transfer order is given to the remitting bank; for other payment methods, on the day after the contract is concluded. If the last day of the period falls on a Saturday, Sunday, or a public holiday recognised at the place of delivery, the next business day shall take its place.
(3) If the carrier returns the shipped goods to the Seller because delivery to the customer was not possible (e.g. due to an incorrect address or non-collection), the customer shall bear the costs of the unsuccessful shipment and any return shipping costs, unless the customer is not responsible for the circumstance that led to the failed delivery or was temporarily prevented from accepting the offered service.
§ 5 Retention of Title
The delivered goods remain the property of the Seller until all claims arising from the purchase contract have been fully satisfied.
§ 6 Warranty
(1) The statutory warranty provisions apply.
(2) For used goods (e.g. antiquarian books), the warranty period for consumers is one year from delivery of the goods to the customer. This shortening of the warranty period expressly does not apply to claims for damages, claims for defects that the Seller fraudulently concealed, or claims arising from any guarantee the Seller may have assumed.
(3) The customer is asked to report goods delivered with obvious transport damage to the carrier and to notify the Seller accordingly. The customer's statutory warranty rights remain wholly unaffected if the customer does not comply with this request.
§ 7 Final Provisions and Online Dispute Resolution
(1) All legal relationships between the parties are governed by the law of the Federal Republic of Germany, excluding the United Nations Convention on Contracts for the International Sale of Goods (CISG). For consumers, this choice of law applies only insofar as it does not deprive the consumer of the protection granted by mandatory provisions of the law of the state in which the consumer has their habitual residence.
(2) If the customer is a merchant, a legal entity under public law, or a special fund under public law with its registered office within the territory of the Federal Republic of Germany, the exclusive place of jurisdiction for all disputes arising from this contract shall be the Seller's place of business.
(3) The language of the contract is English.
(4) The European Commission provides a platform for online dispute resolution (ODR), which can be accessed at https://ec.europa.eu/consumers/odr. We are neither obliged nor willing to participate in dispute resolution proceedings before a consumer arbitration board.
