Folio (310 x 190mm). [40], 2002 cols., [7]. Woodcut printer’s device of Oporinus, alluding to the myth of Arion, the musician being rescued by a dolphin. Later speckled calf, edges stained red; (lightly browned, some marginal worming and few pages remargined at rear, otherwise a good and sturdy copy of this rare work). Manuscript ex libris of Joseph Szapary to title. Szapary (1754-1822) was a count of the Austrio-Hungarian Hapsburgs based in Vienna and contemporary of Mozart. Bookplate of the Szapary coat of arms to front pastedown. Seminal 16th-century work on Roman law and tradition from the Oporinus press. Nicolaus Vigelius was a 16th-century lawyer who proposed a new legal system for the Roman Empire, a system of which he was deeply critical. He wrote of the learned law, "The worst of all (its) vices is the uncertainty that proceeds from the disputations and opinions of the commentators." Vigelius believed many important legal questions were subject to doubt and discussion, which in turn caused lengthy, scholarly controversy. He was incensed over the common practice of some laws being left open to local customary practice. Combatting this dissent, Vigelius advocated in this work that no legal system can tolerate endless uncertainty and that the existence of such an academic consensus was one way Roman law avoided, or at least minimized, that danger. Vigelius actively published several titles throughout his career, although his works are not commonly found and this title remains especially rare. Located only in few European institutions in Switzerland, Sweden, the Netherlands and twice in Germany, where it is fully digitized at the BSB Munich. N° de ref. de la librería KK6498
