Final Report of the Review Group on Intelligence and Communications Technologies

In the summer of 2013, a cascade of leaked documents forced the United States to confront how its intelligence agencies surveilled the world, and its own citizens. President Obama's response was to convene five of the country's sharpest minds and ask them a hard question: can a free nation protect itself without ceasing to be free? Their answer is this book. Liberty and Security in a Changing World is the final report of the President's Review Group on Intelligence and Communications Technologies, transmitted to the President on December 12, 2013. Its authors, Richard A. Clarke, Michael J. Morell, Geoffrey R. Stone, Cass R. Sunstein, and Peter Swire, brought together expertise in counterterrorism, intelligence, constitutional law, regulatory policy, and privacy. Announced by the President on August 27, 2013, the Group was charged with recommending principles to guide intelligence policy for the coming years and decades. The immediate occasion was the disclosure of classified information about National Security Agency collection, which revealed the bulk gathering of telephony metadata under Section 215 of the Foreign Intelligence Surveillance Act and the targeting of non-United States persons under Section 702. Rather than auditing past practice in detail, the Group built a forward-looking framework around enduring principles, and its forty-six recommendations span surveillance law, organizational design, the security of digital communications, and the protection of classified information. The report's intellectual core is its rejection of the familiar metaphor of balancing liberty against security. Some safeguards, the authors insist, are not subject to balancing at all, because officials must never use surveillance to punish political enemies, suppress dissent, or burden groups by religion, ethnicity, race, or gender. In place of balancing they offer risk management, weighing risks to national security alongside risks to privacy, civil liberties, foreign relationships, and trade. Their most consequential proposal would end government storage of bulk telephony metadata in favor of private retention queried only when justified. Other recommendations impose prior judicial review on National Security Letters, extend the Privacy Act of 1974 to non-United States persons, make the NSA Director a Senate-confirmed post open to civilians, separate that office from US Cyber Command, reform the Foreign Intelligence Surveillance Court, and prohibit the government from undermining commercial encryption standards. A chapter on the lessons of history draws on the Church Committee's warning that an agency operating in secret can become a menace to free government. This Nimble Books edition faithfully reproduces the full report and adds a complete editorial apparatus newly prepared for this volume. A Historical Context essay reconstructs the post-disclosure crisis and the authors' mandate. Two complementary plain-language abstracts open the material to every reader, an accessible explain-it-simply summary and an advanced analytical summary that examines the document's clarity, institutional specificity, and limits. A Glossary defines terms such as metadata, bulk collection, and the third-party doctrine; Indexes of persons, places, and concepts make the text navigable; and an original computational RKHS knowledge-graph analysis situates the report among related works on surveillance and civil liberties. For scholars, law students, librarians, policymakers, and engaged citizens, this is a primary document of the surveillance reckoning that followed 2013, distilled in its concluding line: free nations must protect themselves, and nations that protect themselves must remain free.
