From 1 January 2027 any person living in a Georgia community association development can file a complaint with the Secretary of State. You do not need a lawyer. You do not pay to file. And the moment the complaint is filed, the association is prohibited from collecting the fines and fees you are disputing - automatically, with no bond, no hearing and no judge.
The $100 administrative fee is paid by whoever loses. For a homeowner staring at a collection letter, that makes filing the cheapest move available.
Hardly any owner knows this exists.
Written in plain English by JP O'Connor, who has chaired the committee that runs a residential building since 2019 and has been on both sides of a collection letter. This book explains the mechanics and then tells you who to take them to. It does not tell you what to do about your own dispute.
Honest about what is not settled. The Secretary of State had published no rules, no forms and no portal when this went to print. Every procedural detail that depends on them is flagged, not guessed.
General information about Georgia law. Not legal advice.
