The Bank Is Not the Problem takes a fresh look at this difficult question by returning to the foundations of Islamic law. Rather than beginning with the assumption that every transaction involving interest must be identical, Cherif Fadel Aidara asks a more basic question: What did the Qur’an and Sunnah actually prohibit as ribā, and how did the classical jurists understand it?

The book examines the different approaches of the Ḥanafī, Mālikī, Shāfiʿī, and Ḥanbalī schools, the meaning of ribā al-nasīʾah and ribā al-faḍl, the debate over the ʿillah of ribā, and the enormous transformation of money from gold and silver to modern fiat currency. From there, it turns to the modern bank and asks whether every financial relationship should be treated in exactly the same way.

Mortgages, business loans, student loans, car financing, credit cards, and Islamic financing are examined not simply by their names, but by what actually takes place within the transaction.

This is not a book written to make ribā permissible. Nor does it claim that every conventional loan is lawful. It is an argument for greater precision before declaring a modern financial transaction prohibited in the name of Islam.

The prohibition of ribā is clear. The difficult question is identifying exactly where ribā begins and where it ends.
