Sinopsis

The present research work will develop the subject called "Principles and rights of the jurisdictional function enshrined in the Political Constitution of Peru", related to the judicial and constitutional law, which irradiates in all branches of law. In the first part, the subjects referred to the Jurisdiction and aspects referred to that subject will be developed, as well as its function and elements that characterize it, with which a solid notion about the Jurisdictional Function will be acquired. Later, the Principles and rights that inspire the Jurisdictional Function constitutionally recognized in the Political Constitution of Peru of 1993 will be developed. These are regulated in article 139. Of the mentioned constitutional body in Chapter VIII of the Judiciary. And at the same time they are reflected in the Organic Law of the Judiciary in the First section about the General Principles, it is worth mentioning that the jurisprudence issued by the Constitutional Court of Peru will be taken into account because this body is the maximum interpreter of the Constitution and therefore closely linked to the present work.
