Entsprechend müssen die von der Troika geschlossenen Memoranda of Understanding mit der Kompetenzordnung übereinstimmen. Sie dürfen die nach Artikel 6 des EU Vertrages verbindlichen Menschenrechte nicht verletzen. Allerdings greifen die Memoranda of Understanding in Grund- und Menschenrechte ein. Das betrifft z.B. das Recht auf Wohnung und soziale Sicherheit, das Recht auf Gesundheit und zahlreiche Rechte der europäischen Arbeitsverfassung. Konkrete Beispiele sind Eingriffe in die Gesundheitsversorgung (erhöhte Zuzahlung für Medikamente) und in das Tarifvertragssystem einzelner Staaten (Aushöhlung der Tarifautonomie). Dies wirft grundsätzliche Fragen hinsichtlich der Rechtmäßigkeit der Maßnahmen auf.
