Excerpt from An Essay Upon the Constitutional Rights as to Slave Property: Republished From the "Southern Literary Messenger", For Feb; 1840
The chancellor then examined the pleadings in the cause, by which the fact appeared to be admit ted on the record, that the plaintiff owed service or labor to the defendant in another state, and had os caped from such servitude. Without reference to the validity of the act of Congress, or of any state legislation on the subject, he considered the fact thus admitted sufficient, under the constitution, to entitle the defendant to judgment for a return of the slave. And he therefore arrived at the conclusion, that the judgment of the supreme court should be affirmed with costs; and that the damages which the defendant in error had sustained, by the delay and vexation caused by the writ of error, should be awarded to her.

Paperback. Condición: New. Print on Demand. This book examines the constitutional provisions that were the basis for the agreement made between the free and slave states in regard to slavery. It explores the debates that were held in the various state conventions as the constitution was ratified. It includes the text of the Fugitive Slave Act of 1793 and analyzes several legal cases that were tried under it. The author brings to light the complex and sometimes paradoxical legal issues resulting from the effort to balance the protection of individual liberty with the recognition of property rights in persons under a constitutional system created by a nation founded on the self-evident truth that all men are created equal.
