Besides the essential procedural steps and pleadings in the general chancery practice, state and federal, this edition also notes the numerous changes effected by the New Federal Equity Rules in force February 1, 1913. Where state statutes or court rules are silent, state courts usually follow the federal practice. Thus, the new federal rules will affect the state practice also, and it becomes important to understand these changes.
In these few pages of text and forms, are gathered the fruits of nearly five hundred decisions. Profitable as the reading of cases always is, no student can be expected to study and digest so many actual cases in the time given to the subject, even in the best law schools. The reading of cases may well be supplemented by a concise text book explaining the successive proceed ings and pleadings in a suit, so that what the student may not learn from the reading of cases, he will find in the text book.
Fair and just procedural rules are an indispensable part of the administration of justice. Courts cannot transact business without such rules. Lawyers are sup posed to be familiar with them. The large number of cases reversed for errors of procedure show that this branch of the law should receive a larger share of at tention and study. It is hoped this book will aid towards a ready knowledge of the essentials. In the selection of essentials, in the new arrangement and analysis of these essentials, in the classifications and tables, the author hopes will be found a logical, concise and simple exposition of chancery procedure.
