Explore how centuries of church law shaped divorce and remarriage in England This edition surveys the Reformatio Legum Ecclesiasticarum and key cases, including the Stawell matter, to reveal how early English church law influenced marital outcomes.
The work frames the evolution of canon law, its conflicts with royal authority, and the way courts addressed dower, reconciliation, and divorce. It combines critical excerpts with scholarly notes to illuminate legal thought, procedural steps, and the limits of reform in a changing religious landscape.

Excerpt from English Church Law and Divorce: Notes on the Reformatio Legum Ecclesiasticarum; Notes on the Divorce and Re-Marriage of Sir John Stawell
We are greatly indebted to the Rev. Claude Jenkins, the Lambeth Librarian, for the invaluable assistance he has rendered in respeét of Part I and its Appendices, by copying this ms., writing the introduétion to it, com piling the Index, reading proofshand helping in other ways. Many of the extraé'ts from the works of writers of the sixteenth century were furnished by Mr. Jenkins, and but for his learning and industry would not have been discovered. Much assistance in searching for and copy ing records of cases in the Ecclesiastical Courts has been received and is gratefully acknowledged in the text and footnotes, but special mention should be made of our obligations in this respeé't to Mr. Kenneth Munro and Mr. W. J. Hardy, who have given valuable help in the preparation of Part I. In the text, as dis tinguished from the Appendices, modern spelling has, for the sake of clearness, been generally employed.

Excerpt from English Church Law and Divorce: Notes on the Reformatio Legum Ecclesiasticarum; Notes on the Divorce and Re-Marriage of Sir John Stawell
These notes would probably not have been written but for the discussions as to the attitude of the Church of England in relation to Divorce, raised by witnesses before the late Royal Commission on that subject. The Divorce Commission of 1853 reported that as a matter of fact Divorce a vinculo had been granted by the English Church Courts during the half-century which followed the compilation of the Reformatio Legum, and that that work, although not formally authorized and indeed for a great portion of the period not even in print, had nevertheless been virtually in operation until the beginning of the seventeenth century. As these statements were repeated and relied on in the evidence before the recent Commission, it seemed desirable that the matter should be more fully investigated, and with that object a memorandum was prepared and added to the other evidence (Minutes of Evidence, vol. iii, pp. 42-58). This memorandum has since been consider ably enlarged and, so enlarged, forms Part I of this book. The opportunity has been taken to give in more detail than has been hitherto done the history of the preparation of the Reformatio Legum. Part II consists of an account of the important but little known divorce case of Sir John and Lady Stawell, the facts of which are now for the first time published.

Paperback. Condición: New. Print on Demand. This book delves into the history of the Reformatio Legum Ecclesiasticarum, an ambitious but ultimately unsuccessful attempt to reform ecclesiastical laws. The author traces the Reformation's origins to the reign of Henry VIII, when Parliament empowered a commission of 32 to revise canon law, with a focus on divorce. Amid the religious and political turmoil of the 16th century, the commission's work was influenced by prominent figures like Archbishop Cranmer and the foreign Protestant reformer Peter Martyr. Despite being incomplete at Henry's death, the Reformatio was revived under Edward VI and finally published in 1571, albeit without royal assent. It proposed sweeping changes to divorce laws, allowing it in cases beyond adultery, but encountered resistance from both the Crown and the Church of England. The author explores the Reformatio's significance in the broader context of religious and legal reforms in Tudor England, shedding light on the complex interplay between church and state in shaping societal norms during a transformative period.
