I had already prepared and written a considerable part of a work on the Common Law Procedure Acts of 1865 (similar in plan to this one) when I found that, in order to render it complete as a guide for practice, it would be necessary to incorporate with it The Statute of Evidence, 1864, or to prepare a separate work upon it, as a companion volume. I determined to adopt the latter course.

In this little work I have not attempted to touch upon the general principles of the Law of Evidence; these form one of the most extensive and difficult branches of law, upon which there are many large and well-known English text books. The reason why I have prepared this compilation, and the purpose for which it is intended, are as follows: -
