Excerpt from The Recall of Judges: An Essay Read Before the Chit Chat Club of San Francisco
The petition must contain a general statement of the grounds on which the removal is sought. This state ment, however, is intended solely to inform the voters of the grounds on which the proposal to recall is founded; and no matter how flimsy it may be, its sufficiency is not open to review.

The last session of the California Legislature has submitted to the people of this State, for adoption, an amendment to their Constitution providing that every elective public officer of the State may be recalled, or removed from the office to which he has been elected, and that his successor may be simultaneously elected, by a majority vote of the electors entitled to vote, and who actually do vote, at an election called for that purpose.
The procedure provided in this amendment for recalling the officer and electing his successor, is substantially as follows:
A petition signed by a certain number of the electors who are entitled to vote for a successor of the officer sought to be removed must be addressed to the Secretary of State and be filed with the Clerk or Registrar of Voters of the county or city and county in which the petition is circulated. But no petition can be filed against an officer unless he has held office for six months; except that in the case of members of the Legislature it may be filed after five days from the convening or organizing of the Legislature.
The petition must contain a general statement of the grounds on which the removal is sought. This statement, however, is intended solely to inform the voters of the grounds on which the proposal to recall is founded; and no matter how flimsy it may be, its sufficiency is not open to review.

Paperback. Condición: New. Print on Demand. This book analyzes a proposed amendment to California's constitution that would allow the recall of elected officials. It is a timely contribution to the current debate on electoral reform, as more and more states consider adopting similar measures. The author provides a historical overview of the recall amendment from its origins in the Articles of Confederation to its recent implementation in various states and municipalities. The book explores the motivations behind the recall movement, including the decline of representative government and the rise of populist sentiments. It also examines the potential benefits and drawbacks of the recall, arguing that while it may enhance democratic accountability, it could also undermine the independence of the judiciary and lead to political instability. Ultimately, the book concludes that the recall amendment is a complex issue with no easy answers and that its adoption should be carefully considered in light of its potential consequences.
