Le leggi di procedura, può dirsi, che, a preferenza delle leggi civili, siano state di buon'ora, presso molti popoli, codificate. Un popolo può facilmente reg gersi con leggi non scritte, ma il procedimento, come quello che tocca l'ordina mento e la pubblica amministrazione dello Stato, ha dovuto necessariamente rego lare con leggi scritte, le quali, se anche non siano state sanzionate dal potere legislativo furono almeno approvate e pubblicate con editti di Magistrati con ordinanze di parlamenti, o con decreti di tribunali.
Ma non vi è opera più difficile per un legislatore quanto quella di un codice di procedura civile. Molti codici di procedura vi sono, ma quale di essi ha avuto il progresso ed i miglioramenti che ha avuto il codice civile?
