La conclusion de ce qui précède est que lajustice pénale ne peut légitimement s'exercer qu 'autant qu'elle appuie les puni tions qu 'élle inflige sur cette double condition 1° que l'acte a punir soit immoral, ce qui constitue la justice intrinsèque de la punition; 2° que la punition soit nécessaire àla conservation de l'ordre social. Telles sont les règles dont le développement forme la science du droit pénal.
