Enfin on ajoute que la prescription n'est extinctive que si elle est opposée par le débiteur, et même, suivant une cer taine opinion dont nous aurons à examiner la valeur, qu'elle est plutôt une fin de non-recevoir opposable aux poursuites du créancier, qu'un mode d'extinction de la créance.
