Excerpt from Involuntary Terminations Under Explicit and Implicit Employment Contracts
One would expect that an explicit or implicit contract with a pay provision like the one just discussed would also have a provision designed to protect workers from being cheated out of the return promised for the second half of their worklives. At least in the u.s., the most common type of provision providing this protection found in explicit (union) contracts ?h3 one which calls for layoffs in inverse seniority order.4 But what goes on in nonunion settings? How prevalent are implicit last - in-first-out termination policies? Are they as binding in all states of nature (that is, as strong as those which are found under unionism?

Paperback. Condición: New. Print on Demand. This book explores why workplaces favor policies that protect senior employees from being laid off before those with less seniority, despite the fact that the senior employees are often paid more than their contribution to the company, while junior employees are paid less. The author's investigation draws on surveys from a sample of US firms and data from a major US corporation. Among their findings are that approximately 70 percent of the non-union workforce in the US outside of agriculture and construction are employed where last-in-first-out termination policies go hand-in-hand with compensation policies that favor employees with seniority, and that this probability is much higher under unionism. Furthermore, the job security provisions afforded senior non-union personnel appear to be less strong than those provided to union members. The author concludes that these policies may be motivated by the need to protect employees against being cheated out of the return promised for the second half of their work lives.
