Mr. Douglas proposed states should have complete control over their politics and policies, but Northern territories led by President Buchanan and the Supreme Court, advocated for federal oversight to protect the rights of blacks. This created a divide between those who believed the Constitution prohibited slavery in territories, and those who argued it was permissible and should be up to individual states. The author countered that both arguments were off base as the Constitution neither prohibited nor permitted slavery in territories, leaving it to federal policy to decide. The book uses the slavery debate to explore the nuances of federalism and the limits of states' rights, offering insights into the complex relationship between national unity and local self-determination.
