When placed in custody by the courts, whether in prisons or special hospitals, offenders enter closed and powerful institutions where the decisions of others govern major aspects of their lives. Through an examination of decision-making in relation to the treatment, transfer, discipline and release of prisoners and offender patients, this book reveals an important but neglected area of criminal justice, and seeks to assess the ability of the law to facilitate the proper exercise of public power through the regulation of 'process'.
Drawing upon research from a wide variety of sources, together with the findings of the 1991 Woolf Report on prison disturbances and the 1992 Report on Ashworth Special Hospital, Genevra Richardson looks at the way in which the policies affecting prisoners and offender patients are both formulated and applied, and compares patient practice with the possible demands of 'full process'.
Law, Process and Custody provides an excellent resource for students studying public law, criminal justice and the administration of the penal system.

About the Author:

William Twining is the Quain Professor of Jurisprudence Emeritus at University College London and a regular Visiting Professor at the University of Miami School of Law. He was a pupil of Karl Llewellyn in 1957 8 and put Llewellyn's very extensive papers in order after his death in 1962. Twining's recent writings include Rethinking Evidence, 2nd edition (2006), General Jurisprudence (2009) and How to Do Things with Rules, 5th edition (with David Miers, 2010), all published by Cambridge University Press and recognizable as part of the realist tradition.

Christopher McCrudden FBA is Professor of Human Rights and Equality Law at Queen's University Belfast and William W. Cook Global Law Professor at the University of Michigan Law School.
