In 1798 the Schooner "Nancy" was contracted by the Appellants to carry perishable goods back from Lisbon. The "Nancy" sailed and was taken as Prize by Spanish Privateers. Appellant contended that the facts concealed were not material to the risk (a running ship, without convoy) and that it was not necessary to state that the Nancy was a Prize or captured ship going home for condemnation and that the underwriters might have known she was not a British ship. Judgement appended in p.10 of Respondents' case. Judeges presiding - SAMUEL ROMILLY and John Dickson. Parliamentary papers of this period are rare.
