4to. pp. xii, 255. folding engraved frontis. contemporary calf-backed bds. (binding worn, repair to front hinge, moderate foxing & browning throughout, plate backed & with some chipping to edges & some very minute loss to engraved surface at bottom centre). early ownership entry of Daniel Van Voorhis with note "Moovd My Family Out into the Backwoods in the Month of October in the year of Our Lord 1786". First Edition of "the first and classic history of New York State" (Streeter), based on the official records of the administration of New York and on the works of Colden and Charlevoix. The history extends to 1732; further continuations were incorporated into a number of later editions. Separate chapters are devoted to trade, religion, politics and law. The folding plate depicts Oswego on Lake Ontario. Smith was a judge and executive councillor and from 1780-83 chief justice of New York. A Loyalist during the Revolutionary War, he left New York in the great evacuation of 1783. In England he was involved in the preparation of a number of reports on the future government of the British North American colonies, including one which recommended that they be united. In 1886 he emigrated to Canada as chief justice of Quebec and assisted in framing the Constitutional Act of 1791 when Quebec was divided into Upper and Lower Canada. Bell S352. Church 1023.
