Case from Scotlands Court of Session concerned the insolvency of Charles Stueuart from 1775 and creditors liability for the funds of the bankrupt estate (Lethindy Bank, Gowrie, Perth). "Lethindy Bank, 8th Nov. 1775 - I last week informed you of my melancholy situation, that with what I am owing to Mr. Mercer of Lethindy, I can have no view of paying my debt; and for that reason,.I have called a meeting of my creditors, to meet at CUPAR on Thursday next, and to them intend to make a total surrender of every thing, except the clothes my wife and I wear."
