9781939007506: 2013 Competition Case Law Digest A synthesis of EU and national leading case

This EU Digest 2013 is a selection of 51 essays on European competition case laws from the 27 European Union member States and neighboring States. Each essay consists in a synthesis of the leading cases from 2012 and beyond. These essays are organized in two parts. Part I deals with Competition Provisions (Cartels, Dominance, Merger, State aid...) whereas Part II deals with Business Sectors (Automobile, Broadcasting, Healthcare, IT & Telecommunications, Sports...). The purpose of this Digest is to provide a snapshot of the areas of convergence and remaining diversity of competition law in Europe. As noted by Frédéric Jenny in his Foreword below, while this book is not based on a comprehensive study of all national case laws, no such study is needed to identify the main trends in this area. This EU Digest highlights both convergence and divergence in various areas and sectors of European competition law, making it easy for both practitioners and academics to draw comparison between jurisdictions in various areas and sectors of European competition law.

Review:

This book fills a gap opened 10 years ago with the decentralisation of competition enforcement. It gives handy access to a goldmine of national cases. A must consult for any thorough research on EU competition law. --Nicolas Petit, Liège University.

This book is the first real digest of essays on EU and mostly national case law in the area of competition law. As such, it is the Bible in terms of doing research on how a specific competition law issue has been treated by the courts in Europe. Any practitioner or academic that wants to do research on a specific competition law topic must start from this digest. This is a wonderful source of case notes and materials. --Assimakis Komninos, White & Case.

This Digest is a unique product for those who want to have a comprehensive and updated view on the true application of antitrust and merger cases both at EU and national level. It is based on the e-Competitions data base compiled since the so-called modernisation of 2004. The Digest provides a unique one-stop access to a synthetic and synoptic approach of these EU and national cases, allowing to taste the degree of convergence between the EU and the national levels. Although State aid covers a few pages only out of the 600 pages (whilst State aid cases are more numerous than antitrust cases before national courts !), the compendium and the analysis of antitrust and merger cases are impressive. A must in every competition law library. The 2014 edition will certainly cover the entire competition law cases! --Jacques Derenne, Hogan Lovells & Liège University.

“Congratulations to everyone involved in producing this superb collection of materials. This is the response to Regulation 1/2003 and the decentralization of the enforcement of competition law that has been needed: it takes just a few minutes of reviewing the contents of the 2013 Competition Case Law Digest to appreciate that it is an invaluable – indeed indispensable – guide to what is happening across the 27 (soon to be 28) Member States. I know that I will be referring to it regularly.” Richard Whish, King’s College London.

- "This volume is a researcher’s heaven. It should be the source of first resort for considering the relationship between EU competition law and the competition laws of the Member States. Organized according to the most important substantive and procedural issues and by principal sectors, the book is a journey through the convergences and divergences of the competition laws of the jurisdictions, with much learned perspective and wise analysis." Eleanor Fox, New York University.

- "This Digest is the most comprehensive, up to date and reliable source of information on antitrust in the EU - at national and European level." Paul Nihoul, Université Catolique de Louvain.

- "The Concurrences e-competitions Antitrust Case Law Bulletin has long been an indispensable source of knowledge on how competition law is actually applied in the EU Member States (and well beyond). After nearly a decade of prodigious reporting, it has occasionally become difficult to see the wood for the trees. The 2013 Competition Case Law Digest comes to the rescue: It groups together cases from the various jurisdictions thematically, covering all areas of competition law and sectors, and in the best comparative law tradition teases out the similarities and differences. And the Digest does much more than that. In shining the spotlight on how the application of European competition law has developed in the Member States, the commentary by distinguished academics and practitioners gives valuable insights into how Regulation (EC) 1/2003 should develop in the future. A ’must purchase’ recommendation for all law libraries, law firms, and anybody interested in the actual practice of European competition law." Florian Wagner-von Papp, University College London.

- "This insightful and thought-provoking compendium will no doubt prove to be an invaluable research and reference tool for scholars and practitioners alike. Despite the diversity and complexity of substantive and procedural issues addressed, including from a comparative law perspective, the presentation is coherent, systematic and user-friendly throughout." Christian Bovet, Geneva University.
