9781939007308: Competition Case Law Digest: A Synthesis Of Eu And National Leading Cases

This second edition of the Digest has a foreword written by Frédéric Jenny and is enriched with a selection of more than 50 essays on European competition case law from the 27 European Union Member States, EU law, and US law. Each essay consists of a synthesis of the leading cases from 1990 onwards. These essays are organized in two parts. Part I deals with Competition Provisions (Cartels, Dominance, Merger, State aid, etc.) whereas Part II deals with Business Sectors (Automobile, Broadcasting, Healthcare, IT & Telecommunications, Sports, etc.). This new edition of the Digest provides an enhanced overview of the areas of convergence and remaining diversity of competition law in Europe featuring also analysis of key areas of US Antitrust law. This book has confirmed to be one of the most valuable and useful resources currently available to build a body of comparative law in Europe. It highlights both convergence and divergence in various areas and sectors of European competition law, making it easy for both practitioners and academics to draw comparisons between jurisdictions.

Review:

"This book fills a gap opened 10 years ago with the decentralization of competition enforcement. It gives handy access to agoldmine of national cases. A must consult for any thorough research on EU competition law." --Nicolas Petit, Liège University.

"This book is the first real digest of essays on EU and mostly national case law in the area of competition law. As such, it is the Bible in terms of doing research on how a specific competition law issue has been treated by the courts in Europe. Any practitioner or academic that wants to do research on a specific competition law topic must start from this digest. This is a wonderful source of case notes and materials." --Assimakis Komninos, White & Case.

"This volume is a researcher's heaven. Itshould be the source of first resort for considering the relationship betweenEU competition law and the competition laws of the Member States. Organizedaccording to the most important substantive and procedural issues and byprincipal sectors, the book is a journey through the convergences anddivergences of the competition laws of the jurisdictions, with much learnedperspective and wise analysis." --Eleanor Fox, New York University.

"This Digest is the most comprehensive, upto date and reliable source of information on antitrust in the EU - at nationaland European level." --Paul Nihoul, Université Catolique de Louvain.

"This insightful and thought-provoking compendium will nodoubt prove to be an invaluable research and reference tool for scholars andpractitioners alike. Despite the diversity and complexity of substantive andprocedural issues addressed, including from a comparative law perspective, thepresentation is coherent, systematic and user-friendly throughout." --Christian Bovet, Geneva University.
