According to the generally accepted opinion of writers on Primitive Institutions, the original position of the married woman was one of slavery, or akin to slavery. By this phrase is meant not merely subjection to superior force, but to legalized force. In all ages, the weak were the victims of the strong, and were often treated with severity not essentially different from the treatment of slaves; but the exercise of force by the strong over the weak did not constitute slavery, even in the most barbarous societies. Unless the law declared men or women to be slaves, they were, in the view of the law, free, notwithstanding their inability to obtain redress.
The common view of marriage as a primitive institution implies in the man more than arbitrary superiority, such as he exercised over the child, which still remained free.
