Die grosse staatsrechtliche und politische Bedeutung des Pro blems der Bundesstaatsschöpfung ist seit dem nordamerikanischen Sezessionskrieg unbestritten. Die sichere staatsrechtliche Erkennt nis der Gründungsvorgänge unseres Reiches bildet die unerlässliche Voraussetzung für das Verstehen unseres ganzen Staatsorganismus. In dem Streit der Meinungen ist schon wiederholt auf die Ent stehung des belgischen Staates hingewiesen worden, die uns wich tige Aufschlüsse zur Lösung des Problems geben könne. Jellinek gebührt das Verdienst, vor allen betont zu haben, dass die Ent stehung des deutschen Bundesstaates und seiner Verfassung nicht als eine isolierte Erscheinung im Völkerleben betrachtet werden dürfe. Deshalb zieht er die andern modernen Staatenbildungen in den Kreis der Untersuchung, u. A. Auch die Entstehung des belgischen Staates Die Bedeutung des Gedankens der reinen Tatsächlich keit der Staatsentstehung für die Lösung des Problems hat zuerst Zorn nachdrücklich hervorgehoben, nachdem ihn bereits Laband in der ersten Auflage seines Staatsrechtes ausgesprochen hatte. Neuer dings hat v. Herrnritt wiederum die Entstehung des Staates einen rechtlich unerklärlichen Vorgang genannt und in dankenswerter 'veise bemerkt, dass sich dieser Vorgang am besten beobachten lasse bei den durch Lostrennung von bestehenden Staatswesen neu ent standenen Staaten. Als schlagendes Beispiel führt er die Losreis sung Belgiens von Holland im Jahre 1830 an, welche er in ihren Grundzügen kurz darlegt.
